The following was issued today by the San Diego Chapter of Mothers Against Drunk Driving:

WHAT: The San Diego Chapter of Mothers Against Drunk Driving (MADD) will
hold a news conference to kick off a statewide drunk driving
crackdown that aims to keep our streets safe at a historically
dangerous period -- Labor Day weekend. MADD is working with law
enforcement this holiday weekend to send the message: if you drive
at or over the illegal limit, you will be under arrest.

The California effort is part of a national drunk driving
crackdown, "Drunk Driving. Over the Limit. Under Arrest.,"
sponsored by the National Highway Traffic Safety Administration
(NHTSA), in partnership with the California Office of Traffic
Safety (CA OTS), the California Highway Patrol (CHP) Border
Division and Avoid the 14. During the crackdown, law enforcement
officials will intensify enforcement of drunk driving laws by
conducting high visibility enforcement efforts such as sobriety
checkpoints and saturation patrols.

At the press conference, media will get to hear from and speak to
some of the key players in local, statewide and nationwide efforts.
Among the visuals will be police cars and motorcycles, a crash
car and a vehicle installed with an ignition interlock. New state
data from NHTSA will be discussed and statewide enforcement
activities for the holiday weekend will be announced.

WHY: Drunk driving is the nation's most frequently committed violent
crime. In 2006, 1,276 people were killed in California in drunk
driving crashes, and nationally, nearly 13,500 people were killed
in crashes where the driver had a blood alcohol concentration of
.08 or higher. Research shows that frequent and highly publicized
sobriety checkpoints and saturation patrols reduce deaths and
injuries due to drunk driving. The two-and-a-half week enforcement
wave in California runs from August 17 - September 3.

High-visibility enforcement, a proven method to reduce the number
of deaths and injuries caused by drunk driving, is one of the four
components of MADD's Campaign to Eliminate Drunk Driving. The other
elements include: mandatory ignition interlocks for all convicted
drunk drivers, development of advanced vehicle technology to detect
and stop drunk drivers, and mobilization of grassroots support.

Two weeks from today is Labor Day. In San Diego & everywhere there is a warning today from the U.S. Secretary of Transportation. The feds have a strong threat:

If you plan to have too many alcoholic drinks and then drive a car in San Diego California, you should not. You will be caught and prosecuted for a San Diego DUI.

Secretary Mary Peters made that promise at a news conference today as she announced a new push for cracking down on DUI/impaired motorists over the Labor Day weekend.

It’s called "Drunk driving. Over the limit - Under arrest".

Mary Peters is the transportation secretary and she says, "Did you know that a first time (San Diego) DUI arrest can cost as much as ten thousand dollars? Once you start adding the legal fees the court costs vehicle recovery and lost wages and other fines the cost can be enormous."

Last year, DUI / alcohol related car crashes in the U.S claimed over 17,500 lives.

Peters said the new campaign focuses on all the players’ police officers who run DUI sobriety check lanes, DUI prosecutors who bring drunk driving offenders into DUI court and the DUI judges who hand down sentences.

A new multiple-agency San Diego DUI program is asking drivers with cell phones to be vigilant, look for swerving cars and other tell-tale signs of possible San Diego drunk driving motorists, then to call "911" when they spot a San Diego California drunk driver.

But San Diego DUI Police said they would rather ask people to avoid dialing 911 to report San Diego drunk drivers, and instead use the regular 10 digit number to reach the appropriate San Diego County DUI police dispatcher.

Carlsbad DUI Police, Mothers Against Drunk Driving, and other North County DUI agencies have teamed together, asking the public to help alert them to possible San Diego drunk drivers by calling "911" on their cell phones when they see an alleged San Diego DUI driver.

Although San Diego California DUI checkpoints have become commonplace, California DUI law enforcement agencies now want the public's help to call "911" when they see a suspected San Diego drunk driver, and to report the location, direction, make, model and license plate of the vehicle to authorities.

But not all authorities want help from the public. The San Diego DUI Police Department said that motorists should steer away from using the "911" system unless it's a life-threatening emergency: the regular phone line would be better.

Yet Carlsbad's DUI Police Department still believe the public should use their cell phones if they are following a suspected San Diego drunk driver and call the emergency number, because most people cannot remember multi-police departments' non-emergency lines.

How Your Miranda Rights Apply in a San Diego DUI case

The Miranda Rights admonition is usually voluntary in San Diego DUI cases and not usually given, for the following reasons:

During the San Diego DUI investigative stage, the San Diego DUI officer has no obligation to advise one of the person of Miranda rights (to a San Diego DUI attorney, to remain silent).

In San Diego Drunk Driving cases, the San Diego DUI officer usually asks all the main DUI questions before arresting (handcuffing), thereby avoiding the issue of having to advise. The person does not have to answer any questions but the person usually does.

Not until handcuffed is the need for the Admonition triggered.

And by that time, the officer normally has all the answers to all the questions needed to arrest for San Diego driving under the influence of alcohol.

After that, the San Diego DUI officer abstains from questioning during custody.

It is not like the officer takes the person downtown and puts them under a hot light: Did you commit a San Diego DUI?

And in San Diego DUI cases, the person has no right to speak to an attorney before deciding whether to take the required breath or blood test (it's called the "implied consent" law when one signs up for one's license).

In sum, the right to remain silent and the right to an attorney are substantially different in a San Diego DUI case.

Caveat: Nonetheless, any interrogating statements made after taken into custody (e.g. in the San Diego county DUI police car: Were you drunk? Yes I was very drunk) may not be used against the person at the San Diego DUI trial and are subject to suppression for failure to admonish.

Esteemed San Diego Judge Retires, after hearing over many San Diego DUI cases
