San Diego police enforcement

San Diego County DUI officers wrote 380 tickets Wednesday during a half-day traffic enforcement operation in Escondido, San Diego DUI attorneys are told.

Cell phone to be hands-free for California drivers - DUI update

California joins five other states in requiring drivers to use hands-free devices when talking on cellphones, an increasing body of research suggests the legislation will accomplish little.

The risk doesn't stem from whether one or both hands are on the wheel, research suggests. It is whether the driver's mind is somewhere else.

The biggest danger is "cognitive capture" -- or being blind to driving cues because one is absorbed in conversations, especially emotional ones.

"There's a common misperception that hands-free phones are safer when the research clearly suggests that they they're both equally risky," said Arthur Goodwin, a researcher at the University of North Carolina Highway Safety Research Center.

California motorists will be required to use a hands-free device to talk on a cellphone starting July 1 under a new traffic safety law. Such laws are already in effect in New York, New Jersey, Connecticut, Utah, Washington state and the District of Columbia.

Hands-free laws have come to be seen as the most politically feasible way to address the dangers of driver distraction because of cellphone use.

Gov. Arnold Schwarzenegger sought to reassure drivers that they need not hang up their phones when he spoke at a signing ceremony for the California law in 2006. "You don't have to stop talking on your cellphone, but use a headset or use a speaker system, and you will be fine."

If hands-free is the path of least resistance, it was still a long, hard slog for Sen. Joe Simitian, the Palo Alto Democrat who sponsored the bill. Simitian tried but failed to win passage for five years before breaking through. He said he persisted because he was sure the law would save lives.

"There isn't a study in the world that says you're safer driving with a cellphone clutched to your ear than when you are driving with both hands on the wheel," he said.

But Goodwin and other scientists say that hands-free laws could actually make things worse by encouraging drivers to make more or longer calls.

Indeed, federal highway safety officials drafted a letter from then-Transportation Secretary Norman Y. Mineta to the nation's governors in 2003 to warn against laws like California's that allow hands-free calling. For reasons never fully explained, the letter was neither signed by Mineta nor sent. According to the letter: ... "overwhelmingly, research worldwide indicates that both hand-held and hands-free phones increase the risk of a crash."

"We are convinced that legislation forbidding the use of hand-held cellphones. . . . will not be effective," the letter says. Such laws "may erroneously imply that hands-free phones are safe to use while driving."

The letter was based on a lengthy review of worldwide research on driver distraction conducted at the National Highway Traffic Safety Administration, a branch of the Department of Transportation. In that 2003 review, the agency's researchers for the first time estimated fatalities linked to cellphone use by drivers, putting the toll at 955 deaths in 2002. They predicted that it would only rise because of the growing use of cellphones and especially such activities as text messaging, former agency officials said.

After a June, 2003 meeting with Department of Transportation authorities, the letter was drafted but then spiked. The fatality estimate was never made public.

"They don't put the numbers out there because the numbers make it a lot harder to explain why you haven't been more active," said Bill Walsh, former senior associate administrator of the agency.

Other published research, however, has resulted in similar findings. A 2003 study by the Harvard Center for Risk Analysis estimated that there are about 2,600 deaths and 12,000 serious to critical injuries a year in crashes involving drivers using cellphones.

Two widely cited studies found a fourfold greater crash risk for drivers using cellphones than for normal driving -- with nearly identical risks for hand-held and hands-free phones. The studies looked at drivers and collisions in Canada and Australia, where cellphone records were available for analysis, unlike the U.S.

A 2006 study by David L. Strayer and colleagues at the University of Utah found that drivers tested on simulators performed about the same when they used cellphones as when they had a blood alcohol-level of 0.08%, which made them legally drunk. The drivers actually did better in braking and avoiding rear-end collisions when alcohol-impaired than when they were talking on hand-held or hands-free phones.

There are some skeptics. A 2006 paper co-authored by James E. Prieger, a professor of public policy at Pepperdine University in Malibu, found that the link between cellphones and collisions was less conclusive, and the crash risks probably lower, than indicated in some of the most prominent studies.

Many folks think cellphones are more dangerous than drunk driving or a San Diego DUI.

California DUI may bring Life in Prison because of California DUI priors?

A California man faces life in prison for a California DUI because of his prior California DUI convictions.

Marcus M. Aubry was pulled over on Interstate 15 in 2006 and arrested for California DUI after going around 100 mph.

According to San Diego California DUI attorneys, as a first San Diego California DUI offense, the crime is usually charged as a misdemeanor and carries a 30-day county jail sentence.

Aubry faces life in prison because of a 1991 conviction of manslaughter, in which three people were killed in an accident caused by Aubry while he was California DUI.
Aubry served a 14-yearprison term as a result of the California DUI conviction, but in 2006 was arrested again for allegedly California DUI.

California DUI attorney prosecutor told the jury that Aubry registered a .14 on the breathalyzer test, almost twice the legal limit. She told the California DUI jury Tuesday that she was confident after hearing all of the evidence, they would return of verdict of guilty of California DUI.

The California DUI criminal defense attorney encouraged the jury to pay close attention to all the evidence and not try to piece together a conclusion until all the evidence has been heard.

“He smelled alcohol, then he jumped to a conclusion that Mr. Aubry was under the influence,” his California DUI lawyer said of the arresting California Highway Patrol Officer. “Everything he did after that was to support the conclusion he had already come to.”

Intoxilyzer 8000 - used by San Diego PD - challenged by Florida DUI attorneys

San Diego Police Department uses the Intoxilyzer 8000 to test San Diego DUI suspects.

Fines have climbed to more than $500,000 against the company that makes Florida's and California's breath-test machines, part of a legal fight that is stalling more than 100 local DUI / drunk driving cases.

Kentucky-based CMI Inc. faces the fines and the possibility of losing future sales as DUI defense attorneys demand to see computer software that runs the Intoxilyzer 8000.

If DUI lawyers get the source code, they could have their own computer experts analyze whether the machines function correctly. It would give them a chance to question blood alcohol readings that are often the most persuasive piece of evidence in a DUI case.

Minnesota officials filed a federal lawsuit against CMI to divulge the code, which the company says is a protected trade secret. DUI Lawyers in Ohio say similar machines there would bring a glut of challenges.

CMI told a panel of three 12th Circuit Court judges Friday that it should not be fined for contempt because Sarasota County courts do not have jurisdiction over the company.

It was the first time CMI has showed up in court here to argue against a Sarasota County judge's order to turn over the source code or pay stiff fines. The fines hit half a million dollars this month.

"It wasn't just the money, it was a sincere desire by CMI to end this," CMI attorney Jarrod Malone of Sarasota said after the hearing.

CMI originally took the issue to the Daviess County District Court in Kentucky. A judge there quashed the subpoena for the source code.

Then a Sarasota County judge said Daviess County courts had no jurisdiction to do that.

"Until we had the coercive fine, they were not here," said Venice DUI defense attorney Robert Harrison, who represents 63 DUI defendants challenging the accuracy of the Intoxilyzer.

DUI Defense attorneys have challenged the Intoxilyzer machines on the software issue for nearly two years, insisting that DUI defendants should know everything about a DUI machine that could send them to prison.

CMI says the source code is a trade secret that can be exploited by competitors. Divulging it would do nothing to prove the accuracy of the DUI machines, CMI says.

In October, the DUI company said it would allow "controlled viewing" of the source code with a protection order and nondisclosure agreements.

Malone said CMI has been appearing in Sarasota courts for the last four or five months trying to resolve issues around protective orders before it will turn over the code.

Like other DUI breath-test machines, the Intoxilyzer 8000 uses a breath sample to measure a person's blood-alcohol content.

A driver is considered intoxicated at 0.08 percent.

An Intoxilyzer 8000 glitch was discovered a month after it was implemented early last year, when state officials realized the DUI machine failed in certain situations.

The state then upgraded the software in the approximately 400 DUI machines used across the state.

The panel did not say when it might order a ruling on CMI's appeal of the fine, but court administrators are preparing for how to handle the backlog of DUI cases after the source code issue is settled.
