Renegade Cop shot DUI suspect while not following guidelines

San Diego DUI lawyers are told that at one point during testimony, Foley walked out of the courtroom, when the gun used by Coronado Officer Aaron Mansker to shoot him on September 3, 2006 was shown to the jury. Foley's lawyers said their client did not want to relive what happened that night.


Mansker was off-duty when he opened fire on Foley in front of his Poway home. The bullet wounds brought about an end to Foley's NFL career.

During his second day on the witness stand, Mansker said he yelled, "Police officer. Stop," at Foley as he exited his car and began walking towards the officer. Mansker said Foley continued his advance, even after he fired a warning shot into some landscaping.

"Did you consider by firing a warning shot, you might be inviting him to fire back in some kind of self-defense," asked Foley's attorney Harvey Levine.

"It was a possibility," Mansker said.

Two shots hit Foley's car, which was being driven at the time by Lisa Maree Gaut, Foley's companion of that night. She was later convicted of assault with a deadly weapon.

Mansker, who was a rookie during the episode, said he fired twice at Foley when the linebacker got within 15 feet of him. Levine displayed pictures showing his client who was hit in the back of the left knee and hip.

Levine asked Mansker why he had to use lethal force.

"Firing the warning shot and somebody's still advancing on me? Yeah, I believe they have a gun," Mansker said.

"Did you really believe he had a gun?" asked Levine.

"Yes sir," said Mansker. "There was no doubt when that hand started reaching for that waistband, he was going for a gun."

"Did you think maybe he had a cellphone under his shirt?" questioned Levine.

"No, sir," answered Mansker.

Levine's questions indicated he believes Foley was much farther away from Mansker than Mansker claims. The officer denied shooting at Foley when Foley was on the ground, or firing two other shots at him. Mansker could not explain why his shell casings were found 45 feet away from where he claimed to be standing when he opened fire.

On Tuesday, Mansker admitted he did not show his badge when he stopped Foley. He also said he wanted to pull the 32-year-old over on suspicion of driving under the influence, contrary to his training. Foley later pleaded guilty to misdemeanor drunk driving, paid a $1,700 fine and was put on five years probation.

Foley is suing Mansker and the city of Coronado for $48 million.

Fire gun while driving - San Diego dui ?

San Diego dui lawyers report that an active-duty Marine was arrested Sunday afternoon on firearms and San Diego dui - driving under the influence charges. He allegedly was spotted firing shots from his car while driving in a residential neighborhood, San Diego dui attorneys said.

The 24-year-old was driving a white Chevy Caprice near Greenbrier Drive and Apple Street about 1 p.m. when witnesses said they say him shooting a gun near an apartment building where several families with children live, San Diego dui lawyers are told.

San Diego dui officers stopped the car and found a .40-caliber Glock semi-automatic under the driver's seat as well as expended shell casings and an empty magazine inside the car, San Diego dui attorneys said. They also found another loaded .40-caliber magazine in the trunk. Three passengers were in the car. The Marine was suspected to be San Diego dui - driving under the influence and was arrested. He was booked into Vista Jail for the San Diego dui charges.

A defense lawyer representing a man facing the death penalty will seek to get the case dismissed because the Sheriff's Department recorded at least one and perhaps dozens of phone calls he had from his client in jail.

Lawyer Christopher Plourd said yesterday that he will file a motion in court today seeking the dismissal of the charges against Mark Jeffrey Brown, who is accused of killing two San Diego women and is awaiting trial. It was the latest fallout in the growing controversy surrounding a system that recorded an unknown number of calls between lawyers and jailed defendants.

The system was shut off last week by the Sheriff's Department after a defense lawyer in another case filed a similar motion objecting to the recording.

The defense lawyers say the recording violates the attorney-client privilege – which says communications between a lawyer and a client are confidential – and a state law that makes it a felony to eavesdrop on jail calls from inmates to lawyers.

Authorities can record calls from inmates to others such as family or friends. The law bans recordings of lawyers, doctors or religious advisers.

The Sheriff's Department has said the system was not supposed to record calls to lawyers whose numbers were entered into a database for the system. However, that database was incomplete and did not contain all the numbers for all lawyers – leading to an untold number of calls being recorded.

Prosecutors could access the recordings from their computers, which has alarmed defense lawyers.

District Attorney Bonnie Dumanis was adamant yesterday that no prosecutors had illegally listened to any of the recordings.

Dumanis said that when an inmate calls from jail, a prerecorded voice announces to the other party that the call is subject to recording. She said continuing to speak after that point amounts to consent to the recording by both sides.

The state law banning attorney-client recordings says eavesdropping occurs when a call is recorded “without permission from all parties.”

“I believe they have given permission by way of continuing to talk once they were told it was recorded,” Dumanis said.

That is an interpretation vigorously disputed by defense lawyers. Plourd said he did not give permission for the recording and never waived the privilege.

Public Defender Steve Carroll said several of his lawyers – who represent the majority of defendants in the county jails – have said they never heard the taped message at the beginning of a call.

Others have said that after hearing the message they said into the phone that it was a protected call to a lawyer and that they specifically did not give consent for it to be recorded.

Carroll also said his office will be asking the sheriff and Dumanis' office to determine the number of cases where recordings were made.

With that list, he said, defense lawyers then will go through their case files to try to determine if any information from the calls was used improperly by prosecutors.

Private criminal defense lawyers are also upset and want Dumanis to conduct a larger investigation, said Michael Crowley, the head of the Criminal Defense Bar Association in San Diego.

He said Dumanis should determine how many cases are involved and prosecute anyone who intentionally violated the law.

Dumanis said she was willing to meet with defense lawyers and discuss the issue but did not embrace the idea of a widespread investigation. She said she has set up a committee to deal with the issue and asserted that no one in her office acted improperly.

“I'm not aware of anyone in our office who has listened to an attorney-client call that has been recorded,” she said.

Although prosecutors had access to the system and were trained how to use it, they were also told to stop listening to any call when they realize it is an attorney-client matter, Dumanis said.

That does not satisfy Plourd. He said he learned in February that a phone call with Brown had been recorded and he alerted prosecutor Tracy Prior. Plourd said Prior told him it was a mistake and should not have happened.

Prior then filed the disc containing the phone recordings with the judge in the case and said in court papers that she did not listen to any calls. She also said she was not aware that attorney calls had been recorded until told by the defense. Similar statements were filed by the paralegal and an investigator on the case.

Plourd said he asked in April for any documents describing any policies and protocols for prosecutors to access inmate communications but was told no such information exists.

Now prominent San Diego Criminal Defense attorneys say the San Diego Sheriff's Department improperly recorded their privileged conversations with jailed San Diego clients. The San Diego Sheriff's Department says it was a mistake and does not know how many such calls were recorded. It is unclear whether San Diego attorney prosecutors listened to the recorded conversations.

San Diego County Sheriff's Department unplugged a system last week that records all phone calls from jail inmates after outraged San Diego criminal defense lawyers realized their conversations with clients also were being recorded.

A San Diego lawyer for the San Diego Sheriff's Department said the recordings, which defense lawyers say are privileged conversations protected by law, were made because of an inadvertent glitch in the telephone system.

But San Diego defense lawyers said the eavesdropping is a felony under state law and can carry penalties of up to $5,000 per call.

They are also concerned that prosecutors – who have access to the recording system from their desktop computers – could have been privy to conversations, too.

In at least one case, a San Diego defense attorney filed a motion this week seeking to get the District Attorney's Office removed from his case.

Jim McMahon, a San Diego criminal defense lawyer with the county Alternate Public Defender, found out that his trial strategy calls with client were recorded when he heard them on a disc provided by prosecutors. It was in a package of materials that all prosecutors are required to turn over before trial.

San Diego prosecutors planned to use some of the phone conversations the client had with friends and associates during the case.

McMahon said he did not know if San Diego prosecutors listened to any of the recordings, adding that the mere fact that they had them was bad enough. “I'm not at all comfortable with the DA being supplied with confidential, privileged phone calls with my client. "

A San Diego lawyer and a special assistant to the San Diego sheriff, maintains it was unknown how many San Diego attorney-client phone calls have been recorded.

However, all of the calls from the San Diego jail that were recorded have an automated message at the beginning warning that the conversation was being monitored or recorded.

Jack Campbell, a prominent criminal defense lawyer and deputy public defender in Vista, said he has heard the warning for some time, but has still raised an objection because he said the law is clear that recording such conversations is wrong. He has filed court papers in a case he is handling to stop the practice.

The San Diego Sheriff's Department launched the recording system in 2003 with AT&T and switched to PCS in February 2007.

Using a San Diego attorney directory, the department uploaded a database of 5,000 phone numbers of local attorneys. If an inmate called one of those numbers, the call would not be recorded.

However, San Diego sheriff's officials said they did not realize how deficient their database really was.

Inmates have no right of privacy in jail, and courts have long held that their phone calls can be taped. But California law prohibits recording conversations from jail between attorneys and clients, San Diego Public Defender Steve Carroll said.

In an e-mail message sent June 11 to all lawyers in his office, Carroll said the law is “unequivocal in its prohibition of this conduct.” In the same e-mail, Carroll said his office is considering filing lawsuits against the San Diego Sheriff's Department and San Diego District Attorney's Office.

He also wrote that referring the matter to the state attorney general also might be warranted.

San Diego District Attorney Bonnie Dumanis said yesterday that prosecutors only recently became aware of the situation and have a committee working on it. She said she takes any breach of the attorney-client privilege seriously.

But she said she was not aware of any instance in which a prosecutor or a district attorney's investigator listened to any protected conversations between San Diego lawyers and clients.

The state law prohibiting eavesdropping on attorney-client calls also bans listening to confidential conversations between doctors and patients, and ministers and penitents.

In January 2007, a newsletter analyzing recent court cases written by prosecutor Robert Phillips and posted on the sheriff's Web site discussed that law. In many instances, eavesdropping on an inmate call is lawful, Phillips wrote.

But listening to attorney-client talks is a felony and “a serious no-no,” he added.

The San Diego sheriff's lawyer said part of the problem occurred when inmates would call attorneys' direct lines or cell phones – numbers that are not usually published in lawyer rosters and directories. Often only the main number for the attorney's law firm or public defender's office is listed; the system is being changed to allow lawyers to have their calls blocked out.

“If a client calls an attorney, and they hear the message that 'this call is being recorded,' they will also get a number to call to say, 'I'm an attorney and need to be put in the database',” a sheriff's lawyer says.

Campbell, the well-respected criminal defense lawyer and Vista public defender, said such a solution is not satisfactory because they put the burden on the defense attorney to opt out. Jack's comments are historically accurate. Few San Diego Criminal Defense Lawyers are more in tune with the system.

Oceanside school defends anti - San Diego DUI message causing hysteria

Oceanside school officials are defending an anti-drunken driving program that caused hysteria among several students who thought their classmates were dead, according to San Diego DUI attorneys.

California Highway Patrol officers visited 20 classrooms at El Camino High School late last month to inform students that their classmates were killed in car wrecks involving alcohol. A few hours later, students were told it was only a simulation. "Just kidding, kids."

Several students cried and some became so hysterical that teachers had to let them in on the secret earlier to calm them down, San Diego DUI lawyers are told.

"They were traumatized but we wanted them to be traumatized," Guidance counselor Lori Tauber maintains. "That's how they get the message."

History of off-duty San Diego DUI chases not part of Foley civil suit vs. Shooting Cop

Unfortunately, jurors in Steve Foley's excessive force suit won't be told the Coronado policeman who shot the former Chargers linebacker has a history of off-duty San Diego DUI / drunk driving chases.

Foley's lawyers wanted to use Officer Aaron Mansker's personnel file to show he violated state law and department policy at least twice by pursuing suspected San Diego DUI / drunk drivers while off duty.

Superior Court Judge Richard Strauss denied the request for this other San Diego DUI / drunk driving chase evidence. The civil trial starts Monday.

Masker was driving his personal vehicle when he spotted Foley driving drunk in September 2006.

Foley was sadly shot twice after Mansker claimed the former Charger walked toward him and allegedly reached into his pants in a threatening manner. Mansker claims he followed Foley because he thought Foley was a threat to others. Authorities initially ruled Mansker shot in self-defense.

The retired football player later pleaded to a San Diego DUI - related offense. Foley filed an excessive force and negligence civil suit against the officer and city of Coronado.

story from Carrick-on-Suir Ireland.



Recently a routine Gardai patrol parked outside a local neighbourhood
tavern. Late in the evening the Garda noticed a man leaving the bar so
intoxicated that he could barely walk.



The man stumbled around the car park for a few minutes, with the Garda
quietly observing.



After what seemed an eternity and trying his keys on five vehicles, the man
managed to find his car which he fell into. He was there for a few minutes
as a number of other patrons left the bar and drove off.



Finally he started the car, switched the wipers on and off (it was a fine
dry night), flicked the indicators on, then off, tooted the horn and then
switched on the lights.



He moved the vehicle forward a few cm, reversed a little and then remained
stationary for a few more minutes as some more vehicles left.



At last he pulled out of the car park and started to drive slowly down the
road.



The Garda, having patiently waited all this time, now started up the patrol
car, put on the flashing lights, promptly pulled the man over and carried
out a Breathalyzer test.



To his amazement theBreathalyzer indicated no evidence of the man having
consumed alcohol at all!



Dumbfounded, the Garda said "I'll have to ask you to accompany me to the
Police station this Breathalyzer equipment must be broken."



"I doubt it," said the man, "tonight I'm the designated decoy".

Minor as passenger of person arrested for San Diego DUI - Vehicle Code 23572

SAN DIEGO DUI Attorney news: The state attorney general's office today filed San Diego DUI drunk driving and other charges against a woman whose traffic confrontation with an off-duty police officer ended with her and her 8-year-old son being shot.

Rachel Silva, 27, was charged with felony child endangerment for putting her son in "circumstances likely to produce great bodily injury or death."

On March 15, Silva allegedly cut off off-duty San Diego police officer Frank White's car in traffic, then chased the car into an Oceanside parking lot, where she rammed it with hers.

According to the San Diego DUI criminal complaint, Silva was driving in an "aggressive" manner, revving her engine as she followed White into the lot. Silva pulled in front of him, put her car in reverse and rammed his, the complaint said. At that point, the officer fired five times into Silva's car, hitting her and her son.

Silva was struck twice in the arm, her son twice in the leg. White has told investigators that he feared for his life when he fired at the car. Silva has two prior convictions for DUI / drunk driving. She is set to be arraigned next month.

The San Diego County district attorney, meanwhile, is probing whether charges should be filed against White, who is back at work, on desk duty.

Silva was charged with felony child endangerment and four misdemeanors, including drunk driving, driving with a suspended license and driving while in possession of marijuana.

In a statement, the attorney general's office said that the circumstances that led to Silva ramming White's car "were insufficient for the filing of a charge of assault with a deadly weapon or any other assault charge against Rachel Silva."

Her San Diego DUI lawyer may try to get the felony child endangerment charge reduced to having a passenger under 14 in connection with this San Diego DUI:

Vehicle Code 23572

(a) If any person is convicted of a violation of Section
23152 and a minor under 14 years of age was a passenger in the
vehicle at the time of the offense, the court shall impose the
following penalties in addition to any other penalty prescribed:
(1) If the person is convicted of a violation of Section 23152
punishable under Section 23536, the punishment shall be enhanced by
an imprisonment of 48 continuous hours in the county jail, whether or
not probation is granted, no part of which shall be stayed.
(2) If a person is convicted of a violation of Section 23152
punishable under Section 23540, the punishment shall be enhanced by
an imprisonment of 10 days in the county jail, whether or not
probation is granted, no part of which may be stayed.
(3) If a person is convicted of a violation of Section 23152
punishable under Section 23546, the punishment shall be enhanced by
an imprisonment of 30 days in the county jail, whether or not
probation is granted, no part of which may be stayed.
(4) If a person is convicted of a violation of Section 23152 which
is punished as a misdemeanor under Section 23550, the punishment
shall be enhanced by an imprisonment of 90 days in the county jail,
whether or not probation is granted, no part of which may be stayed.

(b) The driving of a vehicle in which a minor under 14 years of
age was a passenger shall be pled and proven.
(c) No punishment enhancement shall be imposed pursuant to this
section if the person is also convicted of a violation of Section
273a of the Penal Code arising out of the same facts and incident.

Taping of San Diego DUI inmates' phone calls

After arrested for a San Diego DUI, while still in San Diego DUI jail, do the police listen to calls coming from the jail? Yes!

San Diego Sheriff's Department tapes every call made from the San Diego DUI jail.

San Diego DUI inmates can call out collect. To make the call, they are supposed to use their San Diego DUI booking number. The calls are all saved in the computer. The sheriff's system can simply enter the San Diego DUI booking number and up shows all calls made using that San Diego DUI booking number. They can also identify who is called by a San Diego DUI inmate.

It gets worse. The San Diego County District Attorney’s Office is wired into the sheriff system. The District Attorney can sit in their office and access jail calls. That includes calls between a San Diego DUI inmate and his San Diego DUI defense contacts. They deny listening to San Diego DUI attorney calls.

BE CAREFUL. Don’t talk about the San Diego DUI case, the San Diego DUI witnesses, or the San Diego DUI evidence. There is no such thing as a confidential call where a San Diego DUI arrestee is in the San Diego County Jail.

10. Need to save your driver's license or privileges? Your San Diego Drunk Driving attorney has only ten (10) calendar days to contact DMV!

Do not schedule yourself. 6. Even if you have a license from another state, and even if the officer did not take your license, that state may also take action against your driving privileges.

5. This TEMPORARY DRIVER LICENSE ENDORSEMENT is valid for only thirty (30) days from the issue date.

If a DMV hearing is requested within ten (10) days, your DMV TEMPORARY will be extended & there will be a stay (delay) of any suspension until the outcome of your DMV hearing is determined through the help of your San Diego DUI lawyer.

4. Do not confuse this initial 30 day TEMPORARY DRIVER LICENSE with your court date! The DMV and criminal proceedings are separate and independent. The outcome of one almost never affects the other. Sometimes the San Diego DUI officer or the DMV paper confuses or misleads you to believe that the TEMPORARY DRIVER LICENSE is good "until the court date". If there are approximately thirty (30) days from your arrest date to your San Diego DUI court date, this may just be a dangerous coincidence. There usually are months before your San Diego DUI - DMV hearing takes place.

3. There are three (3) issues at the San Diego DMV hearing if you completed a chemical test. (See reverse side of DMV paper.)

Our Distinguished Faculty
Jon Bryant Artz has focused on DUI law for 37
years. He has successfully defended in excess
of 2,000 DUI cases. Mr. Artz is proud to be an
editorial consultant for Kuwatch et al. California
Drunk Driving Law (two-volume treatise by
James Publishing). He received his B.S. degree
in economics from the University of California,
Los Angeles, and his J.D. degree from the UCLA
School of Law. Mr. Artz has lectured on DUI
topics over the last 25 years for the California
Public Defenders Association, CACJ and to other
professionals. He has taught law as an adjunct
professor at Pepperdine University School of Law.
Mr. Artz has also served as a judge pro tem in Los
Angeles and Malibu. He secured a 7/0 reversal in
People v. Johnson (1974) 10 Cal. 3d 868, the first
interpretation of Penal Code §1192.5. Mr. Artz
drafts creative motions for trial, e.g., to exclude
evidence. Many judges and lawyers refer friends
arrested for DUI to Mr. Artz because he is an
aggressive and skilled attorney and can also work
wonders regarding sentencing.
Donald Bartell is a partner in the firm of Bartell
& Hensel and has been in private practice for over
23 years. He is a graduate of the University of
California, Berkeley, and Notre Dame Law School.
Mr. Bartell is the author of the chapter “Defense
of Drug Cases” in the book Medical-Legal Aspects
of Drugs. He is a contributing author to California
Drunk Driving Law and co-author of the work
Attacking and Defending Drunk Driving Tests along
with the noted toxicologist Anne Imobersteg.
Richard L. Duquette has been a solo practitioner
since 1983, dedicated to representing ordinary
people against the insurance industry and
prosecution in state and federal courts. Mr.
Duquette is a graduate of Gerry Spence, Esq., Trial
Lawyer College and the Western Institute of Trial
Advocacy. He earned his A.A. degree from Orange
Coast Community College, his B.A. degree from
the University of California, Irvine, and his J.D.
degree from Western State University.
Rick Mueller is with the San Diego County
DUI Law Center. He has been in practice for
over 23 years, limiting his practice to DUI/DMV
cases. Mr. Mueller received his J.D. degree from
Chicago-Kent College of Law, Illinois Institute of
Technology. Having been specially recognized as
a contributor to the California Drunk Driving Law
book, he is now the editorial consultant for the
most comprehensive reference book for California
DUI law. The book is known as California’s bible
for DUI defense, and it features some of his hard
work. Mr. Mueller’s materials were featured at
the 2000 annual CPDA DUI seminar and the
2000 Association of California Deuce Defenders’
seminar. He frequently speaks on DUI-related
topics. Mr. Mueller actively defends these cases
and files DMV writs.
Vincent J. Tucci is an attorney with The Law
Firm of Braden & Tucci, which is one of Southern
California’s most respected and feared law firms
in the area of DUI and DMV defense. In the last
six years, Mr. Tucci has personally tried over 80
DUI jury trials with 60 of those jury trials having a
successful outcome for the client in all Southern
California courts with an emphasis in Los Angeles
County and Orange County. He has represented
citizens against the DMV in excess of 500 times.
Mr. Tucci is student certified in standardized
field sobriety tests in accordance with the
standards of the National Highway Traffic Safety
Administration. He has also been certified in
the administration, calibration and maintenance
of the Intoximeter Alco-Sensor IV Preliminary
Alcohol Screening Device. Mr. Tucci is a board
of directors member for the California Deuce
Defenders Association. He is on the editorial
board along with Donald Bartell in Ed Kuwatch’s
seminal work California Drunk Driving Law – the
DUI bible in California. Mr. Tucci graduated with
two bachelor’s degrees from the California State
University, Fullerton, and a J.D. degree from
Whittier Law School. He is also a frequent speaker
for California Attorneys for Criminal Justice at
their annual DUI seminar.
Charles J. Unger practices at Flanagan, Unger,
Grover & McCool with an office in Glendale;
however, he handles cases all over the state.
His practice is focused on driving under the
influence of alcohol litigation, and his attack on
the previously unassailable blood test has caused
the Los Angeles County Sheriff’s Crime Lab to
change the way it captures and preserves blood
in blood test cases. Mr. Unger received his B.A.
degree from Northwestern University and his
J.D. degree from the University of Illinois College
of Law. For 15 years, he taught the Continuing
Education of the Bar “DUI Defense” class at the
University of Southern California and continues
to lecture statewide in the DUI area. He received
his D.Psych. degree from the American Behavioral
Studies Institute and is a psychotherapist as well
as a marriage and family therapist. Mr. Unger
is a diplomate of the American Psychotherapy
Association. He is a speaker for the “Successful
Leaders from our Community” program and has
been named one of the Top 103 Most Influential
People in the Community by the Glendale News-
Press and Foothill Leader. Mr. Unger is also a
columnist for the Glendale-News Press, writing an
op-ed column on legal and psychological issues.

Important DMV information from a San Diego DUI Attorney


What you must do within 10 days of being arrested of a San Diego DUI

10. If you need to save your driver's license or privileges, your San Diego DUI attorney has only ten (10) calendar days to contact DMV!



Do not schedule a San Diego DUI - DMV hearing yourself.

If you contact DMV to schedule a date conflicting with your San Diego DUI attorney's calendar, DMV will not reschedule and you may not get the San Diego DUI attorney of your choice. There is no rush as long as your San Diego DUI attorney contacts DMV by the 10th day from your arrest.



9. The ten (10) day time limit is computed from the Issue date of the SUSPENSION/REVOCATION ORDER AND TEMPORARY DRIVER LICENSE. If time is running out or you are late, contact a San Diego DUI attorney ASAP.



8. This ADMINISTRATIVE PER SE SUSPENSION/REVOCATION ORDER AND TEMPORARY DRIVER LICENSE is the California DMV paper which you should have received.



7. Even if you did not receive this DMV paper, the California DMV will probably take action against your driving privileges.



6. Even if you have a license from another state, and even if the San Diego DUI officer did not take your license, that state may also take action against your driving privileges.



5. This TEMPORARY DRIVER LICENSE ENDORSEMENT is valid for only thirty (30) days from the issue date.



If a DMV hearing is requested within ten (10) days, your DMV TEMPORARY will be extended & there will be a stay (delay) of any suspension until the outcome of your DMV hearing is determined.



4. Do not confuse this initial 30 day TEMPORARY DRIVER LICENSE with your San Diego DUI court date!

The DMV and criminal proceedings are separate and independent. The outcome of one almost never affects the other. Sometimes the San Diego DUI officer or the DMV paper confuses or misleads you to believe that the TEMPORARY DRIVER LICENSE is good "until the court date". If there are approximately thirty (30) days from your San Diego DUI arrest date to your San Diego DUI court date, this may just be a dangerous coincidence. There usually are months before your DMV hearing takes place.



3. There are three (3) issues at the hearing if you completed a San Diego DUI chemical test. (See reverse side of DMV paper.)



San Diego DUI Issues are whether the San Diego DUI officer had probable cause to stop or contact you or whether the San Diego DUI chemical test evidence is beatable.



2. The DMV has the burden of proof to prevail on all three (3) issues. If DMV meets the burden of proof on two (2) issues, you win!

DMV lawyer information after San Diego Drunk Driving arrest

San Diego Drunk Driving / DMV hearings are for a possible license suspension. They are like mini-DUI trials without a jury, but with much different San Diego DMV rules, San Diego DMV laws and San Diego DMV procedures.

A San Diego DUI / DMV hearing is presided over by a Driver Safety Officer (DMV hearing officer) rather than a real judge, an employee of the DMV not trained in law who acts as both prosecutor and judge. As unfair as it is, she or he can legally object to your evidence, rule on her or his own objection, dually engage your San Diego DUI / DMV lawyer, and admit or not admit either party's evidence.



The San Diego Driver Safety Officer offers evidence in the form of documents and/or witnesses. The Driver Safety Officer offers the San Diego drunk driving / DUI police report, DMV records, San Diego DUI alcohol reports and the important San Diego DUI officer's sworn statement entitled a "DS 367." With no Fifth Amendment right at the hearing, your San Diego DUI / DMV attorney usually will not want you to be present at the hearing since the Driver Safety Officer can call you as a witness and force you to testify against yourself if you ill-advisedly appear.



A San Diego DUI lawyer's defenses at an APS hearing are specialized and technical, more so than in criminal court. Frequent San Diego DUI / DMV proof problems - as well as legal, procedural and bureaucratic obstacles - are possible grounds for setting aside the suspension.




Because of the peculiar nature of San Diego DUI / DMV hearings and the absence of an independent San Diego DUI judge to offer some protection, you are strongly advised not to try to represent yourself. Because these are not San Diego DUI criminal proceedings, San Diego County public defenders are unavailable.
