DMV announcement by San Diego DUI defense lawyer

San Diego DUI criminal defense attorneys remind what you must do within 10 days of being arrested for a San Diego Drunk Driving or DUI:

10. If you need to save your driver's license or privileges, your attorney has only ten (10) calendar days to contact DMV!



Do not schedule yourself. If you contact DMV to schedule a date conflicting with your attorney's calendar, DMV will not reschedule and you may not get the attorney of your choice. There is no rush as long as your attorney contacts DMV by the 10th day from your arrest.



9. The ten (10) day time limit is computed from the Issue date of the SUSPENSION/REVOCATION ORDER AND TEMPORARY DRIVER LICENSE. If time is running out or you are late, contact an attorney ASAP.



8. This ADMINISTRATIVE PER SE SUSPENSION/REVOCATION ORDER AND TEMPORARY DRIVER LICENSE is the California DMV paper which you should have received.



7. Even if you did not receive this DMV paper, the California DMV will probably take action against your driving privileges.



6. Even if you have a license from another state, and even if the officer did not take your license, that state may also take action against your driving privileges.



5. This TEMPORARY DRIVER LICENSE ENDORSEMENT is valid for only thirty (30) days from the issue date.



If a DMV hearing is requested within ten (10) days, your DMV TEMPORARY will be extended & there will be a stay (delay) of any suspension until the outcome of your DMV hearing is determined.



4. Do not confuse this initial 30 day TEMPORARY DRIVER LICENSE with your court date!

The DMV and criminal proceedings are separate and independent. The outcome of one almost never affects the other. Sometimes the officer or the DMV paper confuses or misleads you to believe that the TEMPORARY DRIVER LICENSE is good "until the court date". If there are approximately thirty (30) days from your arrest date to your court date, this may just be a dangerous coincidence. There usually are months before your DMV hearing takes place.



3. There are three (3) issues at the hearing if you completed a chemical test. (See reverse side of DMV paper.)



Issues are whether the officer had probable cause to stop or contact you or whether the chemical test evidence is beatable.



2. The DMV has the burden of proof to prevail on all three (3) issues. If DMV meets the burden of proof on two (2) issues, you win!

The San Diego DUI / DMV hearing for a possible license suspension is like a mini-DUI trial without a jury, but with much different San Diego DMV rules, San Diego DMV laws and San Diego DMV procedures. The San Diego DUI / DMV hearing is presided over by a Driver Safety Officer (DMV hearing officer) rather than a real judge, an employee of the DMV not trained in law who acts as both prosecutor and judge. As unfair as it is, she or he can legally object to your evidence, rule on her or his own objection, dually engage your San Diego DUI / DMV lawyer, and admit or not admit either party's evidence.



The San Diego Driver Safety Officer offers evidence in the form of documents and/or witnesses. The Driver Safety Officer offers the San Diego drunk driving / DUI police report, DMV records, San Diego DUI alcohol reports and the important San Diego DUI officer's sworn statement entitled a "DS 367." With no Fifth Amendment right at the hearing, your San Diego DUI / DMV attorney usually will not want you to be present at the hearing since the Driver Safety Officer can call you as a witness and force you to testify against yourself if you ill-advisedly appear.



The San Diego DMV Driver Safety Officer's decision will usually be mailed a few days or even weeks after the hearing. A San Diego DMV / DMV suspension can be set aside or sustained. Poway and San Marcos ordinance to help stop San Diego DUI

San Diego DUI lawyers report an effort under way to create a city ordinance requiring businesses in San Marcos that sell alcohol to have employees trained and certified in responsible beverage service.

The push is coming from the North Inland Community Prevention Program (NICPP), which is funded by the county. It made its case for such an ordinance before the city’s Student and Neighborhood Relations Commission in July.

Clark Kiser, NICPP director, said statistics show that some San Marcos establishments, particularly in Old California Restaurant Row, have become hot spots for excessive drinking and North San Diego county DUI arrests.

That is particularly troublesome to Kiser because the city is home to Cal State San Marcos and Palomar College.

“We’re trying to encourage the city to look at that,” Kiser said. “We want them to look at some places that are having difficulties when transitioning from restaurant to nightclubs. The better trained they are, the more likely they won’t serve to excess.”

A 2007 survey taken in DUI programs run by the county’s Health and Human Service Agency identified several bars and restaurants in San Marcos as being the last place program participants had had drinks before being arrested for San Diego California Drunk Driving / San Diego DUI.

Between January and July of this year, 144 drivers were cited for a California DUI in San Marcos, and there were 46 alcohol-related collisions in the city, according to the San Diego County Sheriff’s Department.

Underage drinking would also be targeted by the ordinance.

According to a California Healthy Kids Survey done by the state Department of Education, 30 percent of ninth-graders and 46 percent of 11th-graders in San Marcos reported using alcohol in the previous month.

San Marcos has 54 retail outlets and 86 bars and restaurants licensed to sell alcohol.

Sting operations run by the state’s Alcoholic Beverage Control (ABC) department, which licenses businesses, showed that 21 percent of San Marcos bars and restaurants sold to underage drinkers, and 12 percent of adults bought alcohol for underage drinkers when asked.

Celeste Young, a NICPP prevention specialist who made the presentation before the commission, said responsible beverage sales and service training would lessen those problems by teaching servers how to detect false IDs and how to refuse service to aggressive or intoxicated drinkers.

Young argued that alcoholic beverage servers shouldn’t be treated any differently than hairdressers, manicurists and food handlers, who must be certified for health and safety reasons.

Similar ordinances requiring certification training for alcohol servers were passed in Poway in 2002 and in Solana Beach in July.

In Poway, the number of local businesses mentioned in last-drink-before-arrest surveys fell from 61 to five in just one year following passage of the ordinance.

During the July meeting, the Student and Neighborhood Relations Commission directed staff to see whether a San Marcos ordinance was feasible. Lydia Romero, deputy city manager, said that the city attorney and code compliance department would have to weigh in and that input would be needed from stakeholders and the public before a decision could be reached.

The staff report is tentatively scheduled for the commission’s Oct. 13 meeting.
ABC offers free responsible beverage sales and service certification training. Classes last three to four hours, said ABC spokesman John Carr. Last year, the department trained almost 18,000 alcohol servers in the state.

The owners and managers of three Restaurant Row businesses — San Marcos Brewery & Grill, Acapulco Mexican Restaurant y Cantina and 55 Yardline Sports Bar and Grill — said they already require ABC training and certification.

San Diego California Judge publicly admonished for reckless driving plea after San Diego DUI charges

San Diego DUI attorneys publicly discovered that a San Diego Judge has been Publicly Censured Over ‘Wet Reckless’ Plea, Vehicle Code section 23103 per 23103.5 .

The Commission on Judicial Performance has publicly admonished San Diego Superior Court Judge Lisa Schall over her conviction stemming from a 2007 arrest for drunk driving.

Seven of the commission’s 10 members voted 6-1 to admonish Schall—who is referred to in the admonishment as Lisa Guy-Schall, in a letter dated Sept. 5.

Judge Schall apparently currently presides over civil trials in the court’s Vista Courthouse, and was arrested on the evening of Sept. 12, 2007 when an officer of the Escondido Police Department conducted a traffic stop after observing her vehicle traveling in the wrong direction on the Centre City Parkway, a divided four-lane highway.

The jurist was charged with driving under the influence of alcohol in violation of California Vehicle Code Section 23152(a) (DUI), and driving with a blood alcohol level in excess of 0.08 percent in violation of Section 23152(b), after she allegedly failed a field sobriety test, and a blood test performed within the hour purportedly indicated a blood alcohol level of approximately 0.09 percent.

She reportedly pled guilty to the lesser offense of alcohol-related reckless driving in March, San Diego DUI lawyers hear.

The commission wrote that Schall’s unlawful conduct “evidence[d] a serious disregard of the principles of personal and official conduct embodied in the California Code of Judicial Ethics,” and violated canons one and two of the code, which require that members of the judiciary maintain high standards of conduct so that the integrity and independence of the judiciary will be preserved, respect and comply with the law, and act at all times in a manner that promotes public confidence in the integrity and impartiality of the judiciary.

“[A]t a minimum,” the commission said, Schall’s conduct was “improper action pursuant to article VI, section 18(d)(3) of the California Constitution,” and voted 6-to-1 in favor of public admonishment.

In determining that a public admonishment was appropriate, the commission noted that Schall had previously received a private admonishment in 1995 and a public admonishment in 1999. The private admonishment addressed Schall’s embroilment in a juvenile dependency case, the commission said, while the public admonishment addressed her abuse of the contempt power during a 1995 incident in which Schall ordered a defendant appearing before her for a hearing on a petition for a restraining order to exit the courtroom.

Schall had found the defendant in direct contempt and sentenced her to five days in jail without citing the defendant for contempt, having the defendant returned to the courtroom, or stating the facts sufficient to constitute contempt. The jurist did not acknowledge any problems with her handling of the matter to the commission.

Then-Gov. George Deukmejian appointed Schall to the San Diego Municipal Court in 1985 and to the Superior Court in 1989. A native of Annapolis, Md., she grew up in Southern California and served eight years as a deputy district attorney in San Diego before taking the bench.

A well-liked jurst, Judge Schall attended Western State University College of Law—now the Thomas Jefferson School of Law—where she earned a joint bachelor’s and law degree in 1977, as well as California State University, San Diego, and previously serviced as the supervising criminal judge in Vista and as head of the court’s Rules Committee.

Recently a routine Gardai patrol parked outside a local neighbourhood
tavern. Late in the evening the Garda noticed a man leaving the bar so
intoxicated that he could barely walk.



The man stumbled around the car park for a few minutes, with the Garda
quietly observing.



After what seemed an eternity and trying his keys on five vehicles, the man
managed to find his car which he fell into. He was there for a few minutes
as a number of other patrons left the bar and drove off.



Finally he started the car, switched the wipers on and off (it was a fine
dry night), flicked the indicators on, then off, tooted the horn and then
switched on the lights.



He moved the vehicle forward a few cm, reversed a little and then remained
stationary for a few more minutes as some more vehicles left.



At last he pulled out of the car park and started to drive slowly down the
road.



The Garda, having patiently waited all this time, now started up the patrol
car, put on the flashing lights, promptly pulled the man over and carried
out a Breathalyzer test.



To his amazement theBreathalyzer indicated no evidence of the man having
consumed alcohol at all!



Dumbfounded, the Garda said "I'll have to ask you to accompany me to the
Police station this Breathalyzer equipment must be broken."



"I doubt it," said the man, "tonight I'm the designated decoy".

Bridge jumping man with dog faces possible 3 + years prison for San Diego DUI

A man who led officers on a New Year's Eve chase while drunk, then killed a police dog by jumping off the San Diego-Coronado Bridge with the animal, pleaded guilty Wednesday to felony charges.

Cory Byron, 28, admitted one count each of felony evading and driving under the influence. He also pleaded no contest to a misdemeanor charge of harming a service animal, said Deputy District Attorney Paul Myers.

Byron, who has previous DUI convictions from 2003 and 2005, faces three years and eight months in prison when he is sentenced Oct. 29 by Vista Judge Joel Pressman, Myers said.

Oceanside police Officer Kedrick Sadler testified at a hearing in April that he had just left his station with his dog, Stryker, when he spotted a possible drunken driver in a pickup truck swerving from lane to lane on nearby state Route 76.

Sadler said he turned on his overhead lights, then activated his siren when the driver didn't stop. Byron made a U-turn against a red arrow at Melrose Drive and went westbound on SR 76, running red lights at numerous intersections before striking a vehicle at College Avenue.

The defendant turned south on Interstate 5, exited at Pershing Drive in downtown San Diego and made a U-turn to return to the freeway, the officer testified.

According to Sadler, the pickup went onto the bridge but stopped at mid-span after striking a wall. He said he deployed Stryker when the defendant got out of his vehicle and acted like he was about to run, despite commands to stay put.

Stryker grabbed Byron's left arm and took him down to the roadway next to a concrete barrier, Sadler said. The dog continued gripping the defendant's arm as he got up and turned in a motion that seemed as if he was trying to fling the canine over the wall, the officer said.

Sadler said he tried to reach the dog, but Byron put his leg onto the barrier and went over with the animal still attached.

Bryon was rescued by San Diego Harbor Police officers immediately after the fall and was hospitalized for more than a week with a collapsed lung and other injuries.
Byron's blood-alcohol level was measured at .17 percent four hours after the pursuit and accident, according to San Diego DUI attorneys.

San Diego DUI attorney checkpoint news for North County California

San Diego DUI attorneys say on Aug. 30, 2,133 cars passed through Carlsbad’s DUI/driver’s license checkpoint. With 614 sent through primary inspection, five field sobriety test were conducted, one driver was arrested for driving under the influence, and 17 vehicles were towed. An additional 26 citations were issued for other violations.

The checkpoint was manned by Carlsbad Police as well as the CHP and other local law enforcement agencies, according to San Diego DUI attorneys . Representatives from Mothers Against Drunk Driving and the families of CHP Officers Sean Nava and Stephen Linen who were killed by drunk drivers also attended.

The checkpoint was held on Palomar Airport Road east of El Camino Real in Carlsbad from approximately 7 p.m. to 1 a.m. It was funded by the California Office of Traffic Safety through the National Highway Safety Administration.

Dual drunk driving checkpoints were conducted in Del Mar and Solana Beach in August.

The Del Mar checkpoint, on Aug. 22, was held from 7:30 p.m. to 1 a.m. near the intersection of Camino Del Mar and 11th Street. It resulted in 664 vehicles contacted with four arrests and three additional citations issued for various other reasons.

The Solana Beach checkpoint, on Aug. 23, was held from 6 p.m. to midnight near the 400 block of Stevens Avenue. During the evening, 339 vehicles were contacted and the sweep netted one arrest and four additional citations issued for other offenses.

This year, law enforcement agencies throughout California are asking for the public’s help in spotting drunk drivers by calling 911. Drivers are asked to be prepared to report the location, direction, make, model and license plate of the vehicle to the authorities so police can follow up appropriately.

Utilizing citizens and motorists to alert law enforcement to possible impaired drivers can greatly enhance the efforts of law enforcement officers in apprehending DUI drivers. This outreach should also serve as a deterrent to potential drunk drivers. Probation for DUI death of houseless San Diego man

San Diego DUI lawyers report a 19-year-old man convicted of San Diego DUI / drunk driving and killing a homeless man walking on a Midtown street was ordered Wednesday to serve a year in county jail and placed on five years' probation.

Alec O'Keefe Rowe of Kensington pleaded guilty in July to gross vehicular manslaughter while intoxicated and hit-and-run in connection with the Jan. 16 incident.

During an emotional hearing, San Diego Superior Court Judge Jeffrey Fraser determined that probation was appropriate given the defendant's age and other factors.

Fraser said that in his 11 years on the bench, he had never given probation in a case with similar charges. But he said Rowe was exceptional given his level of remorse and his commitment to rehabilitation. The judge noted that if Rowe violates the terms of the probation, he will be sent to prison.

“You're getting a break, and whether or not this was the right thing for this court to do will be determined in the next few years,” said Fraser, who noted that Rowe would not be allowed early release from jail.

“If I were you, I'd take advantage of the break you're being given.”

Deputy District Attorney Melissa Vasel had asked the judge to sentence Rowe to six years in prison for killing Darin Albert Victor, 38. She noted that although the courtroom was packed with people who supported Rowe, no one was there to speak on the victim's behalf.

“He's still a person, and he didn't deserve this,” Vasel said in court, adding that she objected to any characterization of the incident as an “accident.”

“Everything that happened that night was a function of Mr. Rowe's choices,” the prosecutor said in court.

Rowe was arrested a few blocks from India and West Washington streets, where Victor was hit around 11 p.m. Witnesses saw him swerving the car he was driving moments before the crash, the prosecutor said.

Rowe fled but was detained by passers-by. Later, his blood-alcohol level was measured at 0.22 percent, the prosecutor said. The legal limit is 0.08.

Before he was handcuffed by sheriff's deputies, Rowe told the judge he was sorry for what he had done and vowed to improve his behavior in the future.

In other California DUI news, drunken drivers met fierce resistance from Shasta County's law enforcement agencies in the latter part of August.

Police say that from Aug. 15 to Monday, officers made 89 drunken-driving arrests in Shasta County.

Although nearly 90 drunken-driving arrests is a hefty number of drivers taken off the road in a short period, it's not the largest DUI crackdown in recent years, said Redding Police Sgt. Mike Thomas.

"It's not a record, but it's pretty darn good," he said.

Last year, during the Christmas holiday, officers arrested 126 alleged DUI offenders — smashing the a previous high of around 40 or so people arrested in 2005 during a holiday DUI enforcement period, he said.

August's arrests came as part of Shasta County's Avoid the Five DUI task force.

Participating agencies included the Redding and Anderson police departments, the Shasta County Sheriff's Office, the Shasta County Probation Department and the California Highway Patrol.

Thomas said that while the sheriff's office and probation department participated in DUI checkpoints, all of the arrests were on state highways or within Anderson and Redding city limits.

More than 350 law enforcement agencies in California and 45 counties participate in the state's AVOID program, which is funded through grants from the California Office of Traffic Safety through the Business, Transportation and Housing Agency.
