The only fatalities reported countywide this weekend occurred in Balboa Park at midnight, when a driver and passenger were killed in a rollover crash.

Statewide, CHP officers made 942 California DUI arrests between Wednesday evening and Saturday morning.

What you must do within 10 days of being arrested for a San Diego DUI or Drunk Driving charge

10. If you need to save your driver's license or privileges, your attorney has only ten (10) calendar days to contact DMV!



Do not schedule yourself. If you contact DMV to schedule a date conflicting with your attorney's calendar, DMV will not reschedule and you may not get the attorney of your choice. There is no rush as long as your attorney contacts DMV by the 10th day from your arrest.



9. The ten (10) day time limit is computed from the Issue date of the SUSPENSION/REVOCATION ORDER AND TEMPORARY DRIVER LICENSE. If time is running out or you are late, contact an attorney ASAP.



8. This ADMINISTRATIVE PER SE SUSPENSION/REVOCATION ORDER AND TEMPORARY DRIVER LICENSE is the California DMV paper which you should have received.



7. Even if you did not receive this DMV paper, the California DMV will probably take action against your driving privileges.



6. Even if you have a license from another state, and even if the officer did not take your license, that state may also take action against your driving privileges.



5. This TEMPORARY DRIVER LICENSE ENDORSEMENT is valid for only thirty (30) days from the issue date.



If a DMV hearing is requested within ten (10) days, your DMV TEMPORARY will be extended & there will be a stay (delay) of any suspension until the outcome of your DMV hearing is determined.



4. Do not confuse this initial 30 day TEMPORARY DRIVER LICENSE with your court date!

The DMV and criminal proceedings are separate and independent. The outcome of one almost never affects the other. Sometimes the officer or the DMV paper confuses or misleads you to believe that the TEMPORARY DRIVER LICENSE is good "until the court date". If there are approximately thirty (30) days from your arrest date to your court date, this may just be a dangerous coincidence. There usually are months before your DMV hearing takes place.



3. There are three (3) issues at the hearing if you completed a chemical test. (See reverse side of DMV paper.)



Issues are whether the officer had probable cause to stop or contact you or whether the chemical test evidence is beatable.



2. The DMV has the burden of proof to prevail on all three (3) issues. If DMV meets the burden of proof on two (2) issues, you win!



1. All a DMV attorney has to do is knock out one (1) DMV issue to save your license & you avoid any reissue fee and/or Proof of Insurance SR-22 filing!

Mobilization Theme Is “Drunk Driving, Over the Limit, Under Arrest”
The City of Solana Beach will be deploying deputies from the Encinitas Sheriff’s Station on a DUI Saturation Strike Team. This San Diego DUI Saturation Strike Team is scheduled for November 22nd, 2008 between 8:00 p.m. and 3:00 a.m. This strike team will seek out drunk drivers in the city of Solana Beach and place them under arrest.
The Sheriff’s Department is placing 30-day holds on vehicles driven by drivers who are unlicensed or have a suspended license. This can be a costly experience with storage costs up to $1,500. Drivers with a suspended license or who are arrested for driving under the influence can incur legal costs amounting to several thousand dollars as well as paying for their stored vehicle.
The California Office of Traffic Safety, along with local law enforcement agencies, encourage citizens to “Report Drunk Drivers, call 911” if they see a drunk driver on the road. Provide law enforcement with the exact location, vehicle make and model and license plate. One call could save a life.
Traffic Sergeant Randy Webb encourages motorists who elect to drink alcoholic beverages during this period, to designate a sober driver or to call a taxi.
This year, the State of California Office of Traffic Safety and the San Diego Sheriff’s Department remind drivers: Drunk Driving, Over the Limit, Under Arrest.
Funding for this program was provided by a grant from the California Office of Traffic Safety, through the National Highway Traffic Safety Administration.

Checkpoints & DUI Saturation patrols facing travelling San Diego folks

The Palm Desert Police Department is set to begin a year-long anti-DUI program aimed at preventing deaths and injuries on our roadways. New enforcement measures to combat impaired driving are coming as a result of a recent $111,706.00 grant awarded by the Office of Traffic Safety to the City of Palm Desert.

The grant activities will specifically target impaired driving offenders as well as educate the public on the dangers of impaired driving. This will be done through the use of DUI/driver’s license checkpoints, warrant searches and stakeouts for repeat DUI offenders, saturation patrols, and court stings where DUI offenders with suspended or revoked driver licenses get behind the wheel after leaving court.

The first of several DUI saturation patrols will be conducted on Saturday, November 22nd. The Palm Desert Police Department takes a zero tolerance stance regarding persons driving while impaired as well as unlicensed drivers.

Most DUI-Drunk Driving stops are for traffic violations such as speeding, unsafe lane changes, illegal turns, etc. Be focused and attentive while driving. Drive at the speed limit. Be sure to turn on your headlights, fasten your seatbelts, etc. Do not play with your car stereo or do anything that will divert your attention from your driving, such as eating in the car while driving or talking on your cell phone.

3. Do not let the police officer check your eyes and do not agree to take other Field Sobriety Tests.
If you are suspected of DUI-Drunk Driving, the police officer will usually first want to check your eyes. He will ask you to hold your head still and follow his pen or finger with your eyes only. This is called the Horizontal Gaze Nystagmus (HGN) test which is a Field Sobriety Test. Nystagmus is the involuntary jerking of the eyes. When the test is administered correctly by the officer and Nystagmus is detected, it can be an indicator that the alcohol is present in the suspected driver’s blood. The problem is that many officers DO NOT administer the test correctly and will often short-cut the test, but yet the officer will write in the arrest report that he/she observed “clues” supporting an arrest for DUI – Drunk Driving. The HGN test is nothing more than a tool for the officer to use to gather evidence that will be used against you. Since the HGN test is a voluntary test, it is your right to elect NOT to participate in the test. An honest officer can not write that you failed a test that you elected not to do. Always be polite, but say to the officer “on the advice of my attorney, I elect not to participate in any filed sobriety tests.”

In addition to the HGN test, other Field Sobriety Tests often given by police officers are: finger to nose, hand pat, finger count, say the alphabet backwards, count backwards, one leg stand, walk the line and turn, and what ever other crazy test the officer can come up with.

Note that only the Horizontal Gaze Nystagmus test, the One Leg Stand test, and the Walk and Turn test are considered Standardized Field Sobriety Tests and are approved by the National Highway Traffic Safety Administration (NHTSA) and the International Association of Chiefs of Police (IACP) and are part of the DWI Detection Standardized Field Sobriety Testing Program. Any other test is simply not reliable as there are no studies supporting them

Like the HGN, all Field Sobriety Tests are completely voluntary and you do not have to take them. Always be polite, but say to the officer “on the advice of my attorney, I elect not to participate in any filed sobriety tests.”

Many law enforcement officers will tell you that if you pass the tests you won’t be arrested. But if the officer smells alcohol on your breath, it is very likely that you will be arrested. Some officers will tell you that if you refuse to take the Field Sobriety Tests, you will go to jail. Do not allow the officer to intimidate you. If you’ve been drinking, you will likely go to jail anyway.

Some officers will also tell you that if you refuse to take the Field Sobriety Tests, they will tell the court and it will be evidence that you are guilty. Field Sobriety Tests are completely voluntary and it is your right to elect not to take the test.

By agreeing to participate in Field Sobriety Tests, you are helping the officer gather evidence and build a case against you. You are giving the officer the opportunity to write in his report that you “failed” the tests. The tests are subjective and the officer’s idea of “passing” is very different than yours. You are better off not giving the officer “evidence” that he will use against you. Again, be polite, but say to the officer “on the advice of my attorney, I elect not to participate in any filed sobriety tests.”

4. Politely elect NOT to answer any questions during the DUI investigation, either before or after you are arrested. You must provide the officer with your driver license, registration, and proof of insurance, but other than that REMAIN SILENT. If the officer asks you if you have been drinking alcohol, simply say “on the advice of my attorney, I choose to exercise my 5th amendment right and remain silent.” It is your 5th Amendment right to remain silent and not say anything that may incriminate you.

The officer will want to ask you questions regarding where you’ve been, what you’ve eaten, how many alcoholic beverages you drank, what were you drinking, when you last slept, etc. By doing so the officer is gathering information to make a quick determination of your drinking pattern, and with this information, the officer will determine if he/she should test your blood alcohol level as soon as possible or wait a while until you have fully absorbed the alcohol in your stomach. In addition, by answering the officer’s questions you are helping the officer gather evidence – your statements- that will be used against you in court. Again, politely say “Officer, I choose to exercise my 5th amendment right and remain silent.”

5. If you are age 21 or over, Decline to take the Preliminary Alcohol Screen (PAS) Breath test. After you’ve been stopped, if the officer suspects that you’ve been drinking, he/she may ask you to blow into a Preliminary Alcohol Screen Breath (PAS) device, which is a hand held device used to detect alcohol in your breath. This test is voluntary but most officers won’t tell you that. Many officers will tell you that you must blow into the PAS device. THIS IS FALSE if you are 21 years of age or older (If you are under 21 years of age, you must agree to take the PAS test).

Although the implied consent law requires that you submit to a “chemical test” to measure the alcohol concentration in your blood if you are suspected of driving under the influence of alcohol or drugs, the PAS device is not one of the chemical tests. The PAS device is a “preliminary” breath alcohol screening device designed to determine the presence and amount of alcohol in your body. If you agree to take the PAS test you will have to take a second test after you are arrested (breath or blood). The officer uses the PAS device results to determine if you will be arrested for DUI-Drunk Driving. PAS devices do not always give accurate results. If you agree to blow into the PAS device, you are helping the officer gather more evidence that will be used against you in court.

Note: If you are on probation for a previous DUI-Drunk Driving conviction, you may have given up your right to decline the PAS device test. Be sure to review your terms of probation if you are on probation for a previous DUI-Drunk Driving conviction and consult a DUI-Drunk Driving defense attorney.

6. Choose a blood test. If you are arrested, choose a blood test rather than a breath test. If you choose a breath test, the officer will know your breath alcohol concentration immediately. He will then write his arrest report having your breath alcohol concentration in mind. The officer is now more likely to embellish facts in the report to support his arrest. For instance: the driver was weaving in the lane, the driver had slurred speech, the driver stumbled when he walked, the driver fumbled in his wallet to get his driver license, etc. - all because the officer knows your breath alcohol concentration before writing his report.

If you choose a blood test, the arresting officer will not know the results of the blood test for weeks. The arrest report will more than likely have been written prior to the blood test results being available. The arresting officer’s report will likely be more objective and honest because the officer wrote it without knowing the level of your blood alcohol concentration. In addition, if you choose a blood test, an experienced DUI-Drunk Driving defense attorney will have the opportunity to have your blood re-tested by an independent laboratory to verify the result as well as check for proper preservative levels, the presence of bacteria, etc. If you choose a breath test, the breath sample is not saved and therefore can not be retested. Also note that things can go wrong with the blood sample, such as bacteria growth, coagulation, etc.

Be sure to take only one test! Some officers will talk an arrestee into taking a breath and a blood test. That’s like having two smoking guns. Take one test only, and take a blood test.

Note: If you have not been drinking alcohol and are being arrested for driving under the influence of drugs, choose a urine test as it is the least accurate test.

7. Make sure your tail lights. turn signals, etc. are working properly. Inspect your car and make sure all lights are working. Also make sure your windows are not unlawfully tinted. Many times persons are stopped by an officer because a tail light is out or the car has some other problem. The officer then smells alcohol when he walks up to the driver’s window and a DUI-Drunk Driving investigation follows. Between the hours of 9:00 p.m. and thereafter, officers on patrol are looking for reasons to stop drivers to possibly get a DUI-Drunk Driving arrest.

8. Always be on your best behavior. Some officers carry digital recorders and record conversations. Also many jails have video recorders so you are being recorded while you are being processed. Be polite.

9. Insist on your three completed telephone calls and make a detailed record of all events. Penal Code § 851.5 entitles an arrested person 3 completed telephone calls. This is your right and therefore you should insist! Call your cell phone and leave yourself a voice message to record your voice, that way if your speech is not slurred the recording can be used as evidence in your defense.

Also remember to make a detailed record of all the events that occurred before being stopped, up to and including being released from custody. Do so while it is fresh in your mind. This information may be helpful in defending your case.

15 years to life for 5th DUI causing San Diego death

San Diego DUI criminal defense lawyers at www.SanDiegoDrunkDrivingAttorney.net/articles report that a man who was on parole for his fifth DUI conviction when he drove drunk on a suspended license, causing a freeway crash that killed a 75-year-old grandmother, was sentenced Wednesday to 15 years to life in state prison.

John Joseph Taskey, 47, pleaded guilty last month to second-degree murder in the Sept. 13, 2007, death of Rosa Degerman.

The victim was a passenger in one of two vehicles carrying family members to watch the sunset at Sunset Cliffs.

Degerman's daughter, Gregoria Vigil, read a letter from her brother about their mother.

"I cannot put into words what losing my loving and beautiful mother means to me," the letter says. "Nothing can replace her."

The victim's family said they wanted Taskey's sentence to be as long as possible so he couldn't hurt other families with his drunken driving.

Every time Taskey drove drunk since 1997, it was with a suspended license, said Deputy District Attorney David Grapilon.

"He clearly doesn't listen to authority," the prosecutor told Judge David Danielsen. "In order to stop this man's driving pattern, he had to kill someone."

Witness John Covey testified last December that he was driving west on Interstate 8 when he saw Taskey's truck rear-end the car carrying the victim, causing it to roll over a number of times.

The driver was able to climb out of the wreckage, but three people were dazed in the back seat and one person was trapped in the front passenger seat, Covey testified.

Degerman, sitting in the back seat, died of her injuries the following morning.

The victim's 11-year-old granddaughter suffered a fractured left shoulder, and a male passenger was treated for a concussion, Grapilon said.

Degerman leaves behind two other grandchildren, the prosecutor said.

California Highway Patrol Officer Jesus Magdaleno testified earlier that Taskey was driving on a suspended license, appeared very disoriented, smelled of alcohol and had an injured finger.

The officer said he had Taskey blow into a breathalyzer to check his blood-alcohol level and the defendant registered a .112 percent and then a .118 percent on a second test. The legal limit for operating a motor vehicle is .08 percent.

Speed was the main reason for the crash, Magdaleno testified.

In return for Taskey's guilty plea to murder, charges of gross vehicular manslaughter while intoxicated, felony DUI and driving with a .08 percent blood-alcohol level or higher were dropped.

Felony child endangerment and misdemeanor California DUI - driving under the influence for woman shot by cop

Rachel Silva, 27, faces up to four years in state prison when she's sentenced March 5 by Judge David Danielson.

Silva and her son were wounded by San Diego police Officer Frank White on March 15 in the parking lot of a Lowe's home improvement store in Oceanside.

The state Attorney General's Office, which prosecuted Silva, alleged that she willfully placed her son under circumstances likely to produce great bodily injury or death.

Misdemeanor counts of driving while possessing marijuana, and driving on a suspended and revoked license were dropped in exchange for her plea.

The prosecution alleged that Silva had a blood-alcohol level of .15 percent when she pulled out of a gas station driveway into the path of White and his wife, who is a Carlsbad police dispatcher, around 9 p.m. The officer had to swerve to avoid the woman's car, and she tailgated him, revving her engine and honking.

Police said she pulled up alongside the couple's vehicle in the parking lot, still shouting, and sideswiped their car, prompting the officer to fire his gun five times.

Silva was struck by two bullets in the arm and her son was hit twice in the left leg.

Silva's California DUI lawyer, Michael Pancer, indicated California criminal sentencing was set for March so authorities can see how well she responds to substance abuse treatment in a residential rehabilitation clinic.

San Diego DMV / DUI Hearing



The San Diego DUI / DMV hearing for a possible license suspension is like a mini-DUI trial without a jury, but with much different San Diego DMV rules, San Diego DMV laws and San Diego DMV procedures. The San Diego DUI / DMV hearing is presided over by a Driver Safety Officer (DMV hearing officer) rather than a real judge, an employee of the DMV not trained in law who acts as both prosecutor and judge. As unfair as it is, she or he can legally object to your evidence, rule on her or his own objection, dually engage your San Diego DUI / DMV lawyer, and admit or not admit either party's evidence.



The San Diego Driver Safety Officer offers evidence in the form of documents and/or witnesses. The Driver Safety Officer offers the San Diego drunk driving / DUI police report, DMV records, San Diego DUI alcohol reports and the important San Diego DUI officer's sworn statement entitled a "DS 367." Alternatively, if your request for an extension is denied by the San Diego DMV supervisor, request an In-person hearing, the Discovery (evidence), a Stay (stop) of the Suspension, and the Name of the Driver Safety Officer.

San Diego county man dies in DUI crash hitting pole

Ocotillo Wells State Vehicle Recreation Area San Diego DUI crackdown
