How to avoid a San Diego DUI New Year's Eve by getting free public transportation

San Diego DUI criminal defense lawyers and San Diego DUI criminal defense attorneys report Transit and state officials encouraged San Diego residents Monday to take advantage of free public transportation on New Year's Eve and reminded revelers not to mix driving with alcohol or drugs so you can avoid a San Diego DUI.

"Ringing in the New Year with friends and family is something we all look forward to, but that's no excuse to act irresponsibly,'' said Jack O'Connell, state superintendent of public instruction.

"This holiday week is historically one of the deadliest times of year for our young people because of drinking and driving,'' he said. "That being said, my message to all Californians, especially our youth, about San Diego DUI - driving under the influence is: Don't do it.''

In an effort to keep San Diego DUI drunks off the road, the Metropolitan Transit System will offer free around-the-clock service on New Year's Eve on select bus routes and all San Diego Trolleys.

More than 7,600 drivers and motorcyclists between the ages of 15 and 20 were involved in fatal traffic crashes nationwide in 2006, according to the National Highway Traffic Safety Administration, and nearly 1,400 of them were found to have blood-alcohol levels of .08 or higher. Minors are legally barred from driving with any alcohol in their system.

Impaired teen drivers are at far greater risk of being involved in a fatal crash than older drivers, according to the DMV. Teen judgment is more impaired by just one or two drinks than older drivers, and their limited experience behind the wheel puts them at even greater risk.

Penalties for teens found to have been drinking and driving include suspension of their driver's license for a year, seizure of their vehicles, fines and San Diego DUI jail time.

"Our young people have their entire lives ahead of them and we cannot let them jeopardize their futures, so let's make sure they celebrate the New Year safely and without drugs and alcohol,'' San Diego DUI criminal defense lawyers suggest.

Riverside California DUI checkpoint

The Lake Elsinore Police Department conducted a DUI/Driver’s License/Safety Checkpoint on Riverside an Grand in the City of Lake Elsinore. The checkpoint was in operation from 6 P.M. to midnight.

What you must do within 10 days of being arrested



10. If you need to save your driver's license or privileges, your attorney has only ten (10) calendar days to contact DMV!


Do not schedule yourself. If you contact DMV to schedule a date conflicting with your attorney's calendar, DMV will not reschedule and you may not get the attorney of your choice. There is no rush as long as your attorney contacts DMV by the 10th day from your arrest.


9. The ten (10) day time limit is computed from the Issue date of the SUSPENSION/REVOCATION ORDER AND TEMPORARY DRIVER LICENSE. If time is running out or you are late, contact an attorney ASAP.


8. This ADMINISTRATIVE PER SE SUSPENSION/REVOCATION ORDER AND TEMPORARY DRIVER LICENSE is the California DMV paper which you should have received.


7. Even if you did not receive this DMV paper, the California DMV will probably take action against your driving privileges.


6. Even if you have a license from another state, and even if the officer did not take your license, that state may also take action against your driving privileges.


5. This TEMPORARY DRIVER LICENSE ENDORSEMENT is valid for only thirty (30) days from the issue date.


If a DMV hearing is requested within ten (10) days, your DMV TEMPORARY will be extended & there will be a stay (delay) of any suspension until the outcome of your DMV hearing is determined.


4. Do not confuse this initial 30 day TEMPORARY DRIVER LICENSE with your court date!

The DMV and criminal proceedings are separate and independent. The outcome of one almost never affects the other. Sometimes the officer or the DMV paper confuses or misleads you to believe that the TEMPORARY DRIVER LICENSE is good "until the court date". If there are approximately thirty (30) days from your arrest date to your court date, this may just be a dangerous coincidence. There usually are months before your DMV hearing takes place.

High speed chase lands man with San Diego DUI

An El Cajon police officer was returning from San Diego County Jail when he spotted a vehicle driving allegedly erratically on northbound state Route 163 near Interstate 8 around 8:30 p.m. Tuesday, El Cajon police Lt. Ron Smithson said. He said the driver, Randy Lile of Poway, allegedly took off at around 80 miles per hour when the officer attempted to pull him over.

Lile allegedly drove to Pomerado Road and Colony Drive in Poway, where he was arrested after a spike strip disabled his vehicle. No one was hurt in the chase.

Lile was booked in county jail on suspicion of drunken driving and allegedly evading a police officer.

The San Diego DUI / DMV hearing for a possible license suspension is like a mini-DUI trial without a jury, but with much different San Diego DMV rules, San Diego DMV laws and San Diego DMV procedures. The San Diego DUI / DMV hearing is presided over by a Driver Safety Officer (DMV hearing officer) rather than a real judge, an employee of the DMV not trained in law who acts as both prosecutor and judge. San Diego DUI gets $1 million to fight drunk driving, Bail increased in DUI accident case in San Diego County

San Diego DUI Lawyers report the holiday season is the worst time of the year for drunk driving tragedies, and that's why it's best time for the San Diego Sheriff's Department to get it's hands on more than $1 million to fight the problem.

Here in San Diego County on average, drunk driving crashes kill two people every week. Pat Hodgkin from Mothers Against Drunk Driving fights for DUI resources and says the cavalry just showed up.

"Everybody is behind this. Everybody is very excited about this," Hodgkin said.

She's talking about a $1.1 million dollar state grant called the AVOID program that the sheriff's department just landed for the first time ever.

Corporal Jason King with the sheriff's department says that money over the next three years will pay for 760 deputies to work extra shifts - a total of 6,000 extra hours, for 32 additional DUI checkpoints and 207 saturation patrols.

"Economically this is going to put extra officers and deputies out on the street to actively pursue DUI enforcement," Cpl. King said.

Sixteen police agencies will team up for the program in cities like Carlsbad, Chula Vista, Coronado, El Cajon, Escondido, La Mesa, National City, Oceanside and San Diego.

That money also means extra patrols at the big drinking events, like opening day at the Del Mar racetrack, St. Patrick's Day downtown and large gatherings at Qualcomm Stadium.

If you end up in jail on a drunk driving offence it will cost you big these days, with court costs, fines and fees, drunk drivers could be looking at $10, 500.

This weekend alone, that grant money will help the sheriff's department organize seven DUI checkpoints and saturation patrols across the county.

In other San Diego DUI news from www.SanDiegoDUI.com, Travis Weber pled not guilty to charges ranging from manslaughter to drinking and driving.

The Prosecutor in the case made some disturbing revelations, saying that Weber admitted to investigators that he'd been on a drinking binge for days before he allegedly hit and killed Costa while Costa road on his bike.

The prosecutor said Weber admitted to investigators that he'd blacked out and didn't remember hitting anything.

The prosecutor said in court "There were no break marks, their was no skid marks."

The prosecutor was able to get Weber's bail raised to one million dollars after telling the Judge about Weber's prior drinking and driving convictions that date back to 1985.

As recently has 2005 he was convicted of drinking and driving with a blood alcohol level of .22 according to the Prosecutor.

Weber allegedly had rear-ended another car just minutes before hitting Costa.

The driver of that car apparently exchanged driver's license information with Weber and then called 911 giving investigators valuable information in charging Weber with the crimes.

consumed alcohol at all!



Dumbfounded, the Garda said "I'll have to ask you to accompany me to the
Police station this Breathalyzer equipment must be broken."

7. Even if you did not receive this DMV paper, the California DMV will probably take action against your driving privileges.

5. This TEMPORARY DRIVER LICENSE ENDORSEMENT is valid for only thirty (30) days from the issue date.


If a DMV hearing is requested within ten (10) days, your DMV TEMPORARY will be extended & there will be a stay (delay) of any suspension until the outcome of your DMV hearing is determined.


4. Do not confuse this initial 30 day TEMPORARY DRIVER LICENSE with your court date!

The DMV and criminal proceedings are separate and independent. The outcome of one almost never affects the other. Sometimes the officer or the DMV paper confuses or misleads you to believe that the TEMPORARY DRIVER LICENSE is good "until the court date". If there are approximately thirty (30) days from your arrest date to your court date, this may just be a dangerous coincidence. There usually are months before your DMV hearing takes place.


3. There are three (3) issues at the hearing if you completed a chemical test. (See reverse side of DMV paper.)


Issues are whether the officer had probable cause to stop or contact you or whether the chemical test evidence is beatable.

San Diego drunk driving holiday arrest follow-up

SAN DIEGO dui lawyers at www.SanDiegodui.com and San Diego drunk driving attorneys at www.SanDiegoDrunkDrivingAttorney.net report that three people died in traffic crashes in San Diego County over the Thanksgiving holiday, compared with five deaths locally during the same period in 2007.

Statewide, traffic crashes claimed 29 lives between 6 p.m. Wednesday and 11:59 p.m. Sunday, compared with 41 traffic deaths during the same period a year ago, said San Diego drunk driving criminal defense lawyers.

CHP officers in San Diego County made 119 San Diego drunk driving / DUI arrests during that period, compared with 137 San Diego drunk driving arrests a year ago.

Statewide, 1,530 DUI suspects were arrested, compared with 1,638 DUI arrests over the Thanksgiving holiday in 2007.

The number of fatalities reflects deaths reported by all law enforcement agencies in California. The DUI arrests are those made only by CHP officers.

A San Diego DUI / DMV hearing for a possible license suspension is like a mini-DUI trial without a jury, but with much different San Diego DMV rules, San Diego DMV laws and San Diego DMV procedures. The San Diego DUI / DMV hearing is presided over by a Driver Safety Officer (DMV hearing officer) rather than a real judge, an employee of the DMV not trained in law who acts as both prosecutor and judge. As unfair as it is, she or he can legally object to your evidence, rule on her or his own objection, dually engage your San Diego DUI / DMV lawyer, and admit or not admit either party's evidence.



A San Diego Driver Safety Officer offers evidence in the form of documents and/or witnesses. The Driver Safety Officer offers the San Diego drunk driving / DUI police report, DMV records, San Diego DUI alcohol reports and the important San Diego DUI officer's sworn statement entitled a "DS 367." With no Fifth Amendment right at the hearing, your San Diego DUI / DMV attorney usually will not want you to be present at the hearing since the Driver Safety Officer can call you as a witness and force you to testify against yourself if you ill-advisedly appear.
