is presided over by a Driver Safety Officer (DMV hearing officer) rather than a real judge, an employee of the DMV not trained in law who acts as both prosecutor and judge. As unfair as it is, she or he can legally object to your evidence, rule on her or his own objection, dually engage your San Diego DUI / DMV lawyer, and admit or not admit either party's evidence.

According to documents, it seems that San Diego DMV Manager Brian Dawson is unhappy that his hearing officers aren’t summarily suspending all people who challenge the California Department of Motor Vehicles evidence in DUI administrative hearings, as he apparently would like to happen. In fact, it looks like there have been just too many “set asides” for his liking.

Instead of setting aside a license suspension action, most of the hearing officers do, in fact, summarily suspend licenses, even when the weight of the evidence is against DMV. According to public documents, Brian Dawson sent a memo out to the hearing officers that the few who actually did issue what San Diego DUI / DMV attorneys call “set asides” were derelict in their duties. That is scary and shocking.

Mr. Dawson apparently sent out a not-so-“confidential” email to his hearing officers telling them he was unhappy with the state of the set asides.

In a second memo to the hearing officers, the DMV Manager apparenty suggested that the Whistleblower statute may apply to anyone who could identify whichever person who originally leaked this hearing officer information to California DUI defense attorneys.

San Diego could save possibly $700,000 to $1.2 million per year if the legislature eliminated the DUI / DMV administrative license suspension hearings. Allow the Superior Courts to handle it in conjunction with the California DUI criminal matters.

The one deadline you must deal with after a San Diego DUI arrest: 10 days to stop suspension action and request hearing!

San Diego DUI criminal defense lawyers are often discussing what you must do within 10 days of being arrested:

10. If you need to save your driver's license or privileges, your San Diego DUI attorney has only ten (10) calendar days to contact San Diego DMV!



Do not schedule yourself. If you contact DMV to schedule a date conflicting with your San Diego DUI attorney's calendar, DMV will not reschedule and you may not get the San Diego Drunk Driving attorney of your choice. There is no rush as long as your San Diego DUI defense attorney contacts DMV by the 10th day from your arrest.



9. The ten (10) day time limit is computed from the Issue date of the SUSPENSION/REVOCATION ORDER AND TEMPORARY DRIVER LICENSE. If time is running out or you are late, contact a San Diego DUI / DMV attorney ASAP.

If there are approximately thirty (30) days from your arrest date to your court date, this may just be a dangerous coincidence. There usually are months before your DMV hearing takes place.



3. There are three (3) issues at the hearing if you completed a chemical test. (See reverse side of DMV paper.)



Issues are whether the officer had probable cause to stop or contact you or whether the chemical test evidence is beatable.

San Diego DUI Criminal Defense Attorney Mary Prevost raises specter whether testing results Bio-Tox supplied to the SDPD were untrustworthy/unreliable

San Diego DUI Criminal Defense Lawyers have known for a long time how hard San Diego DUI / Criminal Defense Attorney Mary Prevost fights corruption and law enforcement malfeasance. This time she is asking the San Diego Police Department to investigate a Riverside County laboratory that conducted forensic work on numerous local criminal cases. Mary Frances Prevost wrote a letter to the department last week astutely pointing out the recent critical controversy involving a Mr. Aaron Layton, a former criminalist for Bio-Tox Laboratories Inc. who admitted falsifying reports “hundreds of times” while working for a Denver laboratory.

“Layton's admissions raise the specter that testing results Bio-Tox supplied to the SDPD were untrustworthy,” San Diego Criminal Defense Lawyer Mary Prevost diligently wrote. Mike Grubb, the San Diego Police Department's crime lab manager, regrettably has indicated his department is unlikely to thoroughly investigate because Bio-Tox has already begun retesting many of the samples in question. Grubb maintains the lab has reviewed Layton's work in more than 1,100 cases, mostly from Riverside County, and that the results were allegedly the same as initially reported. But who really knows?! He claims a small number of San Diego cases – 10 to 20 – have been retested.

According to news reports, the Riverside County Public Defender's Office obtained a different result on a test in a drunk driving case from what Layton originally reported. However, the case was dismissed for other reasons. On March 31, a letter was sent to San Diego County area criminal defense lawyers stating that local authorities were in the process of identifying all criminal cases in which Layton was involved. The letter is signed by representatives of the San Diego County District Attorney's Office and the City Attorney's Office. Paul Levikow, spokesman for the district attorney, said 2,951 local cases involving Layton were identified, some of which were handled by the City Attorney's Office.

Bio-Tox specializes in toxicological analyses such as urine and blood screenings, which are significant in a variety of cases ranging from drunken driving to murder. The lab has conducted forensic work on thousands of cases in San Diego, Riverside and San Bernardino counties. Layton, 30, is no longer employed at Bio-Tox. The problem was first identified in December, when Riverside County prosecutors conducted a routine background check on Layton, who was identified as a potential witness in misdemeanor DUI trials. Authorities discovered that Layton had taken a polygraph test in 2003 while applying for a job in Columbus, Ohio. During the examination, he admitted that he falsified reports while working for a lab in Colorado. Specifically, Layton said he conducted drug screenings but did not do the required confirmatory tests. He then indicated on his reports that those tests had been completed, according to the polygraph records. Layton told the polygraph examiner that he had been instructed by his employer not to conduct the tests because they were expensive and took too much time, according to the documents.
Prosecutors also discovered that Layton was required to register as a sex offender until August 2008 for a sexual assault on a child in El Paso County, Colo. The offense occurred when Layton was 17. He was contacted by the Colorado Springs Police Department in February 2007 for failing to register. He is on probation for six more months.

A Riverside County judge ordered Bio-Tox to turn over a list of criminal cases within his jurisdiction that Layton handled. The lab has until Thursday to submit the ordered list.

San Diego drunk driver crashed a sedan into two parked cars & Williams was never formally charged with San Diego DUI

San Diego DUI lawyers report a suspected drunk driver crashed a sedan into two parked cars on the driveway of a Mission Hills home early Thursday morning but he and his passenger escaped serious injury, San Diego DUI police said.

The sedan crashed into two vehicles parked in the driveway of a house in the 2400 block of Arista Street around 4 a.m., said San Diego DUI attorneys.
The sedan hit the corner driving at, what San Diego DUI police allege, was at least 60 miles per hour and crashed into the vehicles. The car landed upright on its hood against the home.

In other DUI news in San Diego, standout defensive nose tackle for the San Diego Chargers, arrested Feb. 1 on suspicion of drunk driving, pleaded guilty Thursday to a pair of traffic infractions for an illegal lane change and speeding.

Jamal Williams, 32, was never formally charged with San Diego DUI, according to San Diego criminal defense lawyer Greg Turner, who said the San Diego City Attorney's Office filed reckless driving charges against his client.

"Essentially, he pled guilty to what he did," San Diego criminal defense lawyer Turner said outside court.

The San Diego criminal defense attorney said Williams was charged appropriately once it was determined that his blood-alcohol level was .07 percent -- under the state limit of .08 to operate a motor vehicle.

Turner said the case was sensationalized because Williams -- a 350-pound standout defensive player -- was arrested on suspicion of San Diego DUI after he was pulled over going 85 mph on state Route 94 east of downtown.

Turner praised San Diego criminal prosecutors for properly evaluating the case and agreeing to settle it. "They realized very early on it wasn't a DUI case," the San Diego criminal defense attorney said.

Williams -- who was not present for today's court hearing -- will attend traffic school to have the infractions cleared from his San Diego / DMV record, San Diego criminal defense lawyer Turner said. Well-known & well-respected Commissioner Lee Witham also ordered Williams to pay $472 in fines.

Williams will plead guilty tomorrow to two traffic infractions as part of a plea deal stemming from his San Diego DUI arrest Feb. 1, his San Diego criminal defense attorney said. Williams was arrested on suspicion of San Diego drunk driving at 1:30 that morning on state Route 94 east of downtown. But the San Diego City Attorney's office said it only would charge him with San Diego misdemeanor reckless driving after his blood-alcohol content showed 0.07 percent, just under the state limit of 0.08.
To resolve the San Diego case, Williams, 32, will plead to a lane-change violation and speeding. He will be required to take an eight-hour traffic safety class and pay around $300, said his criminal defense lawyer Turner.

A spokeswoman for the San Diego city attorney said last week they didn't believe they could prove a DUI charge beyond a reasonable doubt. Williams' blood was drawn well after the San Diego arrest.

San Diego DUI lawyers are asked about a San Diego DMV / DUI Hearing after checkpoints. The La Mesa Police Department conducted a DUI and Driver License checkpoint in the 8900 block of La Mesa Boulevard on Saturday, April 18, 2009. The checkpoint was operational for six (6) hours.

25 drivers out of 851 vehicles were taken into the secondary inspection area which resulted in 2 of those drivers being further evaluated for driving under the influence of alcohol and/or drugs. Of those drivers that were taken into the secondary inspection area 1 was arrested for DUI, 1 subject was arrested for being under the influence of a controlled substance, 1 subject was arrested for being in possession of Marijuana and 1 subject was released into the custody of the United States Border Patrol when it was determined that he was in this country illegally. In addition to the arrests, 8 vehicles were impounded for driver license violations and 28 citations were issued.

This checkpoint is another reminder from the La Mesa Police Department that driving under the influence of alcohol and driving without a license will not be tolerated. The La Mesa Police Department was assisted by officers from the San Diego County Sheriff’s Department, San Diego County Probation Department, Coronado PD, Escondido PD, National City PD and California State Parks Police.

San Diego County prosecutors said they are still compiling a list of cases Layton tested in their jurisdiction while working at Bio-Tox

California DUI Defense attorneys are questioning the viability of evidence in thousands of criminal cases in Riverside, San Bernardino and San Diego counties because defendants' blood and urine tests were conducted by a forensic lab technician who admitted to fudging his analysis in a previous job.

California DUI lawyers are frantically digging for information on every case Aaron Layton tested on behalf of Riverside-based Bio-Tox Laboratories over two years with the company until he was fired in February. Thousands of cases in the three counties that contract with Bio-Tox have been thrown into question, attorneys and some judges say, because Layton acknowledged lying hundreds of times about his testing while working at a Colorado lab eight years ago.

A Riverside County judge last week ordered Bio-Tox to produce a detailed list of nearly 4,000 county criminal defendants whose cases were tested by Layton. In San Diego, a defense attorney fired off a letter to the city's police department Wednesday urging a probe of potentially thousands of cases Bio-Tox analyzed while Layton worked there.

Layton's toxicology tests "are significant in a wide variety of investigations and prosecutions, from cases involving alleged driving while under the influence, to manslaughter and murder," California DUI Defense Lawyer Mary Frances Prevost wrote the department. "Layton's admissions raise the specter that testing results Bio-Tox supplied to [police] were untrustworthy, " she said.

San Diego police officials did not respond to a request for comment Friday. Prevost contends the department has a duty to investigate whether lab results were compromised because of funding it receives from a forensic science improvement grant.

Layton did not respond to a request for comment. He has declined to comment in published reports.

So far, no cases in any of the counties have been tossed out over Layton's testing. San Bernardino County prosecutors have identified about 4,800 cases Layton analyzed but say they are only obligated to notify defense lawyers about cases in which Layton testified in trial. San Bernardino County Public Defender Doreen Boxer said she intends to go to court to get the entire list.

San Diego County prosecutors said they are still compiling a list of cases Layton tested in their jurisdiction while working at Bio-Tox. The county and the city of San Diego both contract with the company for criminal forensic testing.

Bio-Tox denies any misconduct. Representatives say they are retesting cases Layton handled. Several hundred they've checked so far have been consistent with the initial results, company officials have said.

However, in Riverside County, Supervising Deputy Public Defender Christine Voss said her office got a different test result than Layton reported in one DUI case. That case was dismissed - not because of Layton's analysis but because of Riverside County Superior Court overcrowding.

"We're trying to unravel the degree of the problem," Voss said. "[Layton's] admissions clearly raise concerns for cases. We have a situation where many people have pled guilty and gone to trial based on his test results."

She said her office might attempt to get convictions overturned depending on what the investigation reveals.

The controversy sparked in December when Riverside prosecutors conducted a background check on 30-year-old Layton when he was listed as a potential witness for misdemeanor DUI trials. During the check, they came across results of polygraph tests Layton took while applying for an Ohio police department job in 2003. They found that he admitted to lying about conducting tests for Colorado criminal cases while working for Denver-based Forensics Laboratories Inc. in 2001. Layton also acknowledged forging supervisors' signatures on lab documents to make it falsely appear he had checked test results.

Layton was fired from Forensics Laboratories for unrelated reasons.

Riverside prosecutors alerted defense attorneys and the court. They also told Denver authorities, who said they are investigating thousands of cases Layton tested there. He has not been prosecuted in connection with his forensic testing.

The Riverside County Public Defender's office had gone to court Wednesday seeking a list of all cases Layton had worked on, including tests in San Bernardino and San Diego counties. But Judge Jorge Hernandez ordered Bio-Tox to itemize only Riverside County cases. He ordered Bio-Tox to submit the case list by April 30.

Hernandez said it didn't appear that the company was trying to hide information and he wanted defense lawyers to show evidence of problems with Layton's work before ordering case information from other counties.

The drivers who stand accused of driving under the influence are not criminals. For the most part they are upstanding citizens who vote, pay their taxes and the salaries of the very people who have arrested and will prosecute them. What the police and prosecutors often don't themselves know and don't want the driver arrested for DUI to know is that frequently the evidence used against those arrested for DUI is not solid.

California drivers are regularly stopped for little or no reason and are made to perform embarrassing exercises along the roads and highways of our state in full view of their neighbors. The first thought of anyone passing a driver alongside the road performing these so-called sobriety tests is that the person was driving under the influence. More often than not, however, the California Highway Patrol officer, local police officer or county deputy sheriff was incorrect and the citizen is sent on their way.

The error of the law enforcement officer is revealed only after the citizen has been made to perform the full complement of embarrassing exercises and blow into an optional preliminary alcohol screening (PAS) device. If the device indicates a breath alcohol level below the limit, the citizen is typically allowed to leave. After all, California law does not prohibit driving after drinking some amount of an alcoholic beverage.

Rather, the law prohibits drinking an unknowable amount of an alcoholic beverage which reveals a breath or blood alcohol level at or above 0.08 percent. Notably, the time for the breath or blood test is selected by the law enforcement officer and may be any time within three hours of actual driving. Also notable, the breath and blood machines are maintained by those working for law enforcement agencies.

In the minority of cases where the officers are right and they have stopped a person who has drank enough to place them at or above the legal limit, the citizen will be made to go through the formalities of performing calisthenics for the sole purpose of getting the driver to blow into preliminary alcohol screening (PAS) device typically maintained by a law enforcement officer working for the same agency as the investigating officer. What the police seldom tell the driver is that performing the exercises is not required, nor is blowing into the preliminary alcohol screening device. The only obligation the citizen has is to submit to an evidential breath or blood test.

Notably, the evidential breath test results are based upon a flawed legal assumption. That assumption is that the results of the breath test will yield the same result as a blood test. However, frequently this is not the case. Moreover, the accuracy of the breath test machines cannot be tested by independent laboratories because most companies which manufacture the devices sell them only to law enforcement agencies. This prevents validation or criticism of the method by which the breath sample is analyzed.

However, a citizen may assert the right to a more familiar and seemingly more accurate blood test. Notably, a sample of the blood is retained and may be retested by an independent laboratory. However, the driver will be required to pay for the privilege of a blood test with a mandatory stay in the county jail, regardless of their guilt or innocence.

Star California Baseball Pitcher tragically killed by alleged DUI driver.

He was one of three people killed in a crash at an O.C. intersection Thursday.

Police said a red minivan ran a red light at the intersection of Orangethorpe and Lemon, triggering a three-vehicle collision just after midnight.
