San Diego DMV / DUI Hearing information follows from a criminal defense attorney who speaks August 1 2009 at the Loyola Law School's annual DUI Seminar sponsored by MABA and Felipe "Mad Dog" Plasencia. The San Diego DUI / DMV hearing for a possible license suspension is like a mini-DUI trial without a jury, but with much different San Diego DMV rules, San Diego DMV laws and San Diego DMV procedures. The San Diego DUI / DMV hearing is presided over by a Driver Safety Officer (DMV hearing officer) rather than a real judge, an employee of the DMV not trained in law who acts as both prosecutor and judge. As unfair as it is, she or he can legally object to your evidence, rule on her or his own objection, dually engage your San Diego DUI / DMV lawyer, and admit or not admit either party's evidence.



The San Diego Driver Safety Officer offers evidence in the form of documents and/or witnesses. The Driver Safety Officer offers the San Diego drunk driving / DUI police report, DMV records, San Diego DUI alcohol reports and the important San Diego DUI officer's sworn statement entitled a "DS 367." With no Fifth Amendment right at the hearing, your San Diego DUI / DMV attorney usually will not want you to be present at the hearing since the Driver Safety Officer can call you as a witness and force you to testify against yourself if you ill-advisedly appear.

10. If you need to save your driver's license or privileges, your San Diego DUI attorney has only ten (10) calendar days to contact DMV!



Do not schedule without a San Diego DUI attorney. If you contact DMV to schedule a date conflicting with your San Diego DUI lawyer's calendar, DMV will not reschedule and you may not get the attorney of your choice. There is no rush as long as your San Diego DUI defense lawyer contacts DMV by the 10th day from your arrest.



9. The ten (10) day time limit is computed from the Issue date of the SUSPENSION/REVOCATION ORDER AND TEMPORARY DRIVER LICENSE. If time is running out or you are late, contact a San Diego DUI criminal defense attorney ASAP.



8. This ADMINISTRATIVE PER SE SUSPENSION/REVOCATION ORDER AND TEMPORARY DRIVER LICENSE is the California DMV paper which you should have received.



7. Even if you did not receive this DMV paper, the California DMV will probably take action against your driving privileges.



6. Even if you have a license from another state, and even if the officer did not take your license, that state may also take action against your driving privileges.



5. This TEMPORARY DRIVER LICENSE ENDORSEMENT is valid for only thirty (30) days from the issue date.



If a DMV hearing is requested within ten (10) days, your DMV TEMPORARY will be extended & there will be a stay (delay) of any suspension until the outcome of your DMV hearing is determined.



4. Do not confuse this initial 30 day TEMPORARY DRIVER LICENSE with your court date!

The DMV and criminal proceedings are separate and independent. The outcome of one almost never affects the other. Sometimes the officer or the DMV paper confuses or misleads you to believe that the TEMPORARY DRIVER LICENSE is good "until the court date". If there are approximately thirty (30) days from your arrest date to your court date, this may just be a dangerous coincidence. There usually are months before your DMV hearing takes place.



3. There are three (3) issues at the hearing if you completed a chemical test. (See reverse side of DMV paper.)



Issues are whether the officer had probable cause to stop or contact you or whether the chemical test evidence is beatable.



2. The DMV has the burden of proof to prevail on all three (3) issues. If DMV meets the burden of proof on two (2) issues, you win!

No more non-felonious exigency exception to warrantless entry into the house to drag out your dui person & no more citizen's arrest without PC for cop

Hopkins v. Bonvicino (9th Circuit),talks about whether the cops can enter a home w/out a warrant following a traffic accident where one of the involved motorists says "he looked under the influence, smelled of alcohol, and drove home." The cops go to the home, the occupant won't answer the door, so they cut a hole in a screen door and enter, then arrest the occupant for DUI / hit and run.

The 9th Circuit discusses Welch v. Wisconsin, and the California Supreme Court follow up to that opinion, People v. Thompson. Great quote: "The fact that the California Supreme Court expressed its disagreement with the United States Supreme Court ...and that it took a different view of the Fourth Amendment than this circuit and the United States Supreme Court does not alter our conclusion in this case."
They hold that a warrantless entry to obtain evidence of a misdemeanor will "seldom, if ever" pass Constitutional muster.

This is a wise case. It firmly and correctly puts the California Supreme Court in its place. No more non-felonious exigency exception to warrantless entry into the San Diego house to drag out your dui client. No more citizen's arrest for drunk driving without the San Diego cop having probable cause.

San Diego California DUI fatalities are less, but motorcycle deaths are up / portable breath test options for San Diego drivers (avoid a DUI easily)

San Diego DUI - related deaths are declining.

In fact, every years since 2006, drunk driving deaths in California declined. However, motorcycle fatalities continued a decade-long rise that mirrors national trends.

Total traffic deaths dropped by 14% in 2008, to 3,434, using figures released last month by the National Highway Traffic Safety Administration. DUI / Drunk Driving / alcohol-related fatalities consisted of just less than 1/3 of the total, and were down 9.1% — a slightly smaller decline than for the nation as a whole. California drunk driving deaths were down nearly 21% over 3 years.

Suggested reasons for the DUI death drop: hard, innovative work in education, enforcement, engineering and emergency medical services. An AlcoMate Prestige AL6000 Breathalyzer is a device alot like a typical breathalyzer where you blow into a mouthpiece to get your BAC reading. What makes it different, though, is a patent-pending technology that makes recalibrating this breathalyzer very easy to do. Most breathalyzers must be recalibrated every once in a while, and so you must ship the device somewhere to get calibrated and it ends up taking a lot of time to do all this. The Prestige, on the other hand, features a replaceable pre-calibrated alcohol sensor module that is easy to remove and replace when necessary. (Breathalcolyzer)

Key chain Breathalyzer (about $30)

There are a variety of key chain breathalyzers out there, and this is one of them. These are very convenient, because they are small enough to put on your key chain and are very inexpensive. They won't be as accurate as potentially some of the more expensive models, but they are still better than nothing. This particular one even has a built-in flashlight and stopwatch so it's kinda cool anyway.

Emerging technologies that will help to eliminate California drunk driving

There is some technology in the works right now that we'll probably see in the near future that are built-in to new cars. One of these is a patented sensor that was invented by Dr. Dennis Bellehumeur that would be built-in to a car's steering wheel and prevent the car from starting if it detects too much alcohol or drugs. This sensor works by detecting the amount of alcohol in your sweat. It then sends a signal to your car's ignition system essentially telling it to not start.

Nissan is just one of the automakers that is making the prevention of drunk driving one of their initiatives in their future cars. They are working on 3 prototype systems that would help eliminate drunk driving. One of these systems is a sensor placed in the gear-shift lever that would detect too much alcohol and then disable the ignition system. It would then prompt the driver, via the GPS screen, that alcohol was detected and the car can't be operated.

A second system being tested by Nissan involves a camera being mounted in front of the driver that would monitor the driver's eye movements. If it senses that the driver is dozing off, the car will automatically tighten the seatbelt a few times to try and jolt the driver to wake up.

A third prototype system that Nissan is working on is a sensor that monitors the path of the car. If the car is weaving around the road, the sensor will tighten the driver's seatbelt a few times and give voice and visual prompts on the GPS screen to try and alert the driver that they are all over the road. There's no word yet on when these 3 systems could actually hit the road, but Nissan hopes to begin putting this technology into their automobiles very soon.

The increase has been driven by a roughly similar rise in motorcycle ridership, although California cops also point out the increased deaths are tied to a new generation of bigger, faster, more powerful bikes. Perhaps another reason for the rise in fatalities was more young riders account for those deaths.

Ignition Interlock Devices required to be installed if convicted of driving on suspended license after a DUI or drunk driving in California

One of the main concerns expressed to San Diego DUI criminal defense attorneys is being able to "drive." Driving is so important because of sparse public transportation. One does not want to be driving on a suspended license at any time after being arrested for a drunk driving charge in San Diego California. Penalties are severe.

New laws penalize those who get caught driving on a suspended license after a DUI. In addition to mandatory jail, if convicted, here's some new laws a person needs to be aware of after a San Diego DUI lawyer handles his or her case:

Mandatory Ignition Interlocks. This new law requires Ignition Interlock Devices (IIDs) be installed on vehicles owned and operated by motorists convicted of driving on a suspended license due to a previous alcohol-related conviction.

“There are an estimated 40,000 persons convicted annually of DUI-related offenses who then drive on suspended licenses; further, there were 1,489 people needlessly killed in an alcohol-involved collision during 2007 in California. This law is a major step toward reducing those numbers,” said DMV Director George Valverde.

The DMV must notify the court if you fail to submit proof of installation of an IID within 30 days from date of notice. A person who is required and fails to install an IID is guilty of a misdemeanor and shall be punished by imprisonment in the county jail for not more than six months or by fine of not more than five thousand dollars ($5,000), or both.

Motorists who fall into the category of driving with a suspended license for a DUI-related conviction will be assessed a $40 administrative fee for verification of the IID installation.

Ignition Interlock Devices (IID) (SB 1190, Oropeza) This new law reduces the BAC from .20 percent to .15 percent or more at the time of arrest to trigger a requirement for the court to give heightened consideration for the installation of an IID for a first-time offender convicted of DUI of an alcoholic beverage.

Ignition Interlock Devices (SB 1388, Torlakson) Effective July 2009, this new law transfers authority for the administration of mandatory IID programs from the state courts to the Department of Motor Vehicles (DMV). This law also authorizes the DMV to require any driver convicted of driving with a suspended license due to a prior conviction for DUI to install an IID in any vehicle that the offender owns or operates.

DMV procedure in San Diego after a DUI

A San Diego DUI / DMV hearing for a possible license suspension is like a mini-DUI trial without a jury, but with much different San Diego DMV rules, San Diego DMV laws and San Diego DMV procedures. The San Diego DUI / DMV hearing is presided over by a Driver Safety Officer (DMV hearing officer) rather than a real judge, an employee of the DMV not trained in law who acts as both prosecutor and judge. As unfair as it is, she or he can legally object to your evidence, rule on her or his own objection, dually engage your San Diego DUI / DMV lawyer, and admit or not admit either party's evidence.



The San Diego Driver Safety Officer offers evidence in the form of documents and/or witnesses. The Driver Safety Officer offers the San Diego drunk driving / DUI police report, DMV records, San Diego DUI alcohol reports and the important San Diego DUI officer's sworn statement entitled a "DS 367." With no Fifth Amendment right at the hearing, your San Diego DUI / DMV attorney usually will not want you to be present at the hearing since the Driver Safety Officer can call you as a witness and force you to testify against yourself if you ill-advisedly appear.



The San Diego DMV Driver Safety Officer's decision will usually be mailed a few days or even weeks after the hearing. A San Diego DMV / DMV suspension can be set aside or sustained. Here's the San Diego DMV 10 day deadline information you are looking for after a San Diego DUI arrest

In San Diego, here's what you must do within 10 days of being arrested for a DUI:

10. If you need to save your driver's license or privileges, your San Diego DUI criminal defense attorney has only ten (10) calendar days to contact DMV!



Do not schedule yourself. If you contact DMV to schedule a date conflicting with your San Diego DUI criminal defense lawyer's calendar, DMV will not reschedule and you may not get the attorney of your choice. There is no rush as long as your San Diego DUI attorney contacts DMV by the 10th day from your arrest.



9. The ten (10) day time limit is computed from the Issue date of the SUSPENSION/REVOCATION ORDER AND TEMPORARY DRIVER LICENSE. If time is running out or you are late, contact a San Diego DUI Lawayer ASAP.



8. This ADMINISTRATIVE PER SE SUSPENSION/REVOCATION ORDER AND TEMPORARY DRIVER LICENSE is the California DMV paper which you should have received.



7. Even if you did not receive this DMV paper, the California DMV will probably take action against your driving privileges.



6. Even if you have a license from another state, and even if the officer did not take your license, that state may also take action against your driving privileges.



5. This TEMPORARY DRIVER LICENSE ENDORSEMENT is valid for only thirty (30) days from the issue date.



If a DMV hearing is requested within ten (10) days, your DMV TEMPORARY will be extended & there will be a stay (delay) of any suspension until the outcome of your DMV hearing is determined.



4. Do not confuse this initial 30 day TEMPORARY DRIVER LICENSE with your court date!

The DMV and criminal proceedings are separate and independent. The outcome of one almost never affects the other. Sometimes the officer or the DMV paper confuses or misleads you to believe that the TEMPORARY DRIVER LICENSE is good "until the court date". If there are approximately thirty (30) days from your arrest date to your court date, this may just be a dangerous coincidence. There usually are months before your DMV hearing takes place.



3. There are three (3) issues at the hearing if you completed a chemical test. (See reverse side of DMV paper.)



Issues are whether the officer had probable cause to stop or contact you or whether the chemical test evidence is beatable.



2. The DMV has the burden of proof to prevail on all three (3) issues. If DMV meets the burden of proof on two (2) issues, you win!

4. You have had recent environmental exposure to volatile fumes (lacquer, gasoline, paint, dry cleaning fluids or even 409) which have cumulative reading, causing chemical interference/falsely elevated result.
5. Air bag defenses - "the Tyndall effect' - diffusion of light; propellant exposure; cut lips; lung and airway irritation & fluid build-up from caustic gas propellant.
6. Unintentional alcohol (e.g. from Nyquil, Vicks Formula 44, lip balms, toothache drops).
7. Something in mouth containing alcohol (e.g. Breath Drops with SD alcohol).
8. Something in mouth that contains interfering or contaminating substance (e.g. Skoal snuff - wintergreen; Altoids curiously strong mints).
9. Officer not trained or marginally trained in accordance with the standards of Title 17 of the California Code of Regulations (e.g. not trained in theory of operation of machine).
10. Elevated breath temperature (e.g. caused by fever, hot tub, sauna, detention in hot sun or back of patrol car in summer, dancing, menstrual cycle, etc.)
11. Breath/blood ratio (2100:1) not proven to be your ratio; show how minor error gets multiplied 2100 times; 0.12 = 17/10,000,000th of an ounce. Show you have abnormally low blood/breath conversion ratio through testing and expert.

13. Margin of error (e.g., 0.088 reading - state acknowledges +/- 0.01% precision problem).
14. You have blowing pattern irregularity (e.g. blubbering and crying causing artificially high water vapor problem).
15. You have been on strict high protein diet and then introduce carbohydrates, thereby triggering auto-generated alcohol production when ketones are converted to isopropyl alcohol (or the "auto-brewery" syndrome).
16. You have diabetes, are borderline diabetic or are hypoglycemic and consume alcohol in any amount, causing conversion of high acetone levels into isopropyl alcohol.
