California DUI Lawyers Association sues California DMV – Hooray!

In one long, anticipated destiny, the California DMV has been sued by the California DUI Lawyers Association.

Any San Diego California DUI Attorney who appears in front of the DMV for administrative hearings knows this should have happened a long time.

We are just glad that California DUI Attorney Donald Bartell and prominent California Civil Rights Lawyer Paul L. Hoffman have announced the August 1, 2014 filing of civil complaint in the Superior Court of California, Los Angeles, 111 North Hill Street, Case Number BC 553552.

Causes of action include federal action (42 U.S.C. 1983) and state action (California Con Art I, 7; CA Civ Pro 525(a) and 1021.5).   Monetary, Declaratory and/or Injunctive Relief is being sought.

May true justice prevail so drivers in this state can begin getting fair hearings and hearing officers can begin following the law in an objective approach rather than follow management mandates and memos to suspend licenses.

Known by the California DUI Lawyers Association as the “Department of Morons and Villains,” DMV must now answer to their unfair and biased practices.  While there are a number of fair hearing officers, upper management has engaged in practices designed to uphold administrative suspensions and deny respondents in many ways.

San Diego DUI Attorney Rick Mueller is a bit surprised a California Business & Professions Code Section 17200 et. seq. action was not included.

"17200.  As used in this chapter, unfair competition shall mean and
include any unlawful, unfair or fraudulent business act or practice
and unfair, deceptive, untrue or misleading advertising and any act
prohibited by Chapter 1 (commencing with Section 17500) of Part 3 of
Division 7 of the Business and Professions Code."


The pressure has been mounting to do
something about the California DMV.
