How Can I Avoid DUI Classes in San Diego County, Federal or on U.S. Base Cases?

The answer is easy – have your DUI attorney avoid a DUI conviction.

Vehicle Code Section 23152 is the DUI code to stay away from. You may be charged with:

  • California Vehicle Code Section 23152(a) Driving under the influence of alcohol
  • California Vehicle Code Section 23152(b) Driving with .08% or more.
  • California Vehicle Code Section 23152(e)/(f) Driving under influence of drugs or combination

Driving under the influence of drugs (DUID) in San Diego is a serious offense prosecuted under California Vehicle Code 23152(e) and 23152(f). It is illegal to drive while impaired by any drug, including illegal substances, prescription medications, and over-the-counter drugs.

Ways to avoid San Diego County Superior Court or U.S. District Court military DUI conviction:

  • Get Dismissal of Vehicle Code 23152 [DUI, driving with .08% BAC, DUI – drugs].
  • Plea deal offering to to drop (not pursue) any and all Vehicle Code 23152 charges.
  • Not guilty: Vehicle Code 23152 [DUI].No DUI alcohol program is legally required unless convicted of Vehicle Code 23152 [DUI].

Just because you are charged with DUI does not mean you will be guilty of DUI. Some of the best DUI lawyers successfully challenge and avoid DUI convictions. No DUI alcohol conviction program can be required if there is no 23152 conviction.

If no alcohol classes are ordered by a state or federal (off base or on base) court when there is a Vehicle Code Section 23152 DUI conviction, CA DMV can still later notify the driver of the California Department of Motor Vehicles requirement that the driver complete the program in order to drive. DMV requires a 3 month program for a 1st DUI conviction; 9 months if BAC is reported .20%.
